ORDINANCE AMENDING AUGUSTA-RICHMOND COUNTY
CODE SECTION 6-2-70 (d) TO PROVIDE FOR
ADMINISTRATOR TO APPROVE CERTAIN CHANGES IN
LICENSE OWNERSHIP; TO PROVIDE AN EFFECTIVE
DATE; TO MAKE AN EDITORIAL REVISION TO CODE
SECTION 6-2-61; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE AUGUSTA-RICHMOND COUNTY COMMISSION,
and it. is hereby ordained ~y authority of same as follows:
Section 1.
The Augusta-Richmond County Code shall be
amended by striking subsection (d) of said Augusta-Richmond County
Code Section 6-2-70 in its entirety and inserting in lieu thereof
a new subsection (d) to read as follows:
(d) New ownership; retail alcoholic beverage licenses.
No retail beer, wine or. whiskey license shall be
transferred,
but where a change in ownership is
contemplated,' the new owner or owners shall file a new
application for a license. Changes in license ownership
from one (1) party at interest named in the original
application to another party at interest as named in the
original application, and changes of license from one (1)
employee or manager to a successor employee or manager,
shall not be deemed a transfer of license within the
prohibition
against
transfer
contained
in
these
regula.tions, so long as there is no change in the
ownership or
location.
In each
instance,
the
Administrator for Augusta-Richmond County shall be
advised in writing of such change and. a complete
disclosure of all facts in connection therewith shall be

made at the time such request for change is presented.
The Administrator shall have the authority to approve
such a change of license.
In the event that the
Administrator denies such change of license, the
applicant shall have the right within ten (10) days of
such denial to appeal same to the Augusta-Richmond County
Commission. . An applicant for a change of license must
follow the procedure for applying for an alcoholic
beverage.licens~, excluding ~ 6-2-58 and ~ 6-2-61. A
transfer fee from manager to manager shall be one hundred
dollars ($100.00).
Section 2. - Richmond County Code ~ 6-20-61 is hereby
amended by changing the references from "~~ 6-2-57 through 6-2-59"
to "~~ 6-2-58 through 6-2-60."
Section 3.
This Ordinance shall become effective
immediately upon adoption.
