ORDINANCE TO DESIGNATE CHIEF JUDGE OF STATE
COURT AS CHIEF JUDGE OF MUNICIPAL COURT; TO
DESIGNATE SOLICITOR OF STATE COURT AS
PROSECUTING ATTORNEY OF MUNICIPAL COURT; TO
ESTABLISH THE QUALIFICATIONS OF THE JUDGE OF
MUNICIPAL COURT; TO PROVIDE AN EFFECTIVE DATE;
AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE AUGUSTA-RICHMOND COUNTY COMMISSION,
and it is hereby ordained by authority of same as follows:
Section 1.
The Chief Judge of the State Court of
Richmond County is hereby designated the Chief Judge of Municipal
Court and shall be responsible for the overseeing and directing the
operation of Municipal Court and for allocating and scheduling
cases and other judicial duties so as to distribute the work load
equitably among the Judges having misdemeanor jurisdiction in
Richmond County.
Section 2.
(a) The Judge of Municipal Court shall be
a member in good standing of the State Bar of Georgia and must have
been such a member for a minimum of three (3) years before becoming
Judge.
(b) The Judge of Municipal Court shall
not be members of the Augusta-Richmond County Commission during the
term of the Commission in effect at the time of appointment, nor
shall they be eligible for election to the Commission during such
service as Judge of Municipal Court.
Section 3.
The Judge of the Municipal Court holding
office on the effective date of this Ordinance shall continue in

office until the expiration of the term of office to which such
Judge was originally appointed.
Section 3.
The Solicitor of the State Court of
Richmond County shall serve as the prosecuting attorney in the
Municipal Court.
Section 4.
This Ordinance shall become effective on
June 1, 1997.
