Definitions), Section 22 B-2 (General Business), Section 23 LI (Light
Industry), Section 26 (Special Exceptions), and Section 29 Exceptions

THE AUGUSTA-RICHMOND COUNTY COMMISSION-COUNCIL HEREBY ORDAINS:
SECTION I: That the com1prehensive Zoning Ordinance is amended by adding the
following to Section 2 (Ge~eral Definitions):
n Antenna" shall meal any exterior apparatus designed for telephone, radio, or
television com1munication. \
"Telecommunication Tower" shall mean any structure that is designed and
constructed primarily for the purpose of supporting one or more
antenna1s. The term includes radio and television transmission
towers, I microwave towers, common carrier towers, cellular
telepho~e towers, alternative tower structures, and other similar
structures. Antennas added to existing structures, where the
resultin~ height Including the antenna or antennas conforms to the
maximum height restriction of the zone in which it is located, shall
not be ~onsidered a telecommunication tower but is subject to
review by the Chief Building Inspector.
SECTION II. That the cojprehensive Zoning Ordinance is amended by adding the

following to Section 22 B-2 (General Business):

22-1 (b)(14) Telecommunication towers subject to the following conditions:
(a) The height of ~he tower including antennas does not exceed 165 feet
I
above ground level;
(b) The setback frbm the nearest residence not located upon the same tract
as the proposed tower is equal to or greater than the height of the tower;
(c) There is no other structure within-a one mile radius of the proposed site
I
that is at least 90 percent of the height of the proposed tower, including
'.,antenna; I
(d) Any such structure shall be fenced and provided with a landscaped
b'uffer where it is contiguous to a residential district or use.

SECTION III. That the Comprehensive Zoning Ordinance is amended by deleting the
following from Section 23 LI (Light Industrial) Zone:
23-3 Height: The maximum height of a building in an LI Zone shall not exceed
six (6) stories or seventy-five (75) feet.

. Section. IV: That the Comprehensive Zoning Ordinance is amended by- adding the

following to Section 23 LI (Light Industrial) Zone:
23-3 Height: The maximum height of a building in an LI Zone shall not exceed
six (6) stories or seventy-five (75) feet, except that the height of
telecommunication towers that conform to Section 22-1 (b) of the Zoning
Ordinance be allowed a height up to 165 feet above ground level.
SECTION V. That the Comprehensive Zoning Ordinance is amended by adding the
following to Section 26-1 (Special Exceptions):
26-1 (0) Telecommunications towers that do not meet the conditions for
consideration as permitted uses in the respective zones. Requests for
special exceptions for telecommunication towers shall be accompanied
by a scaled site plan and scaled elevation showing the location and
dimensions of all proposed improvements. Factors to be considered in
determining whether or not a special exception is warranted are as
follows:
(1) Height of proposed structure including antennas
(2) Distance from residences
(3) Nature of surrounding land use
(4) Surrounding topography
(5) Surrounding tree coverage
(6) Ingress and egress design
(7) Design of structure and landscape plan including characteristics
that reduce obtrusiveness
(8) Availability of suitable towers or other structures within one mile
of the proposed site. If structures 90% or more of the requested
height are located within one mile of the proposed location, then
evidence must be provided with the application that existing
structures are not of sufficient strength, or applicant use of
structure would cause conflict with the existing use of structure,
or that the cost of sharing would be unreasonable, or that specific
other factors would make sharing these structures impossible.
SECTION VI. That the Comprehensive Zoning Ordinance is amended by deleting the
following from Section 29 Exceptions and Modifications:
29-2 (d) Structure Permitted above Height Limit: Penthouse or roof structures
for the housing of elevators, stairways, tanks, ventilating fans or similar
equipment required to operate and maintain the building, fire or parapet
walls, skylights, towers, steeples, roof signs, flagpoles, chimneys,
smokestacks, wireless masts, water tanks, silos, gas containers, or
similar structures may be erected above the height limits herein
prescribed, but no penthouse nor roof structure or any space above the
height limit shall be allowed for the purpose of providing additional
enclosed space for residential, commercial, or industrial use.
SECTION VII. That the Comprehensive Zoning Ordinance is amended by adding the
following to Section 29 Exceptions and Modifications:
29-2 (d) Structures Permitted above Height Limit: Certain structures may be
permitted to exceed the maximum height limit for each zoning district.
This shall not be construed to permit any use of property that is not
allowed in the respective zoning districts, nor shall it supersede the need
for special exceptions for telecommunication towers as expressed in
Section 26 (0). Structures that may be permitted to exceed the height
limit are as follows: Penthouse or roof structures for the housing of
elevators, stairways, tanks, ventilating fans or similar equipment required
to operate and maintain the building, fire or parapet walls, skylights,

. s.teeples, flagpoles, chimneys, smokestacks, water tanks, silos, or similar
structures. No penthouse nor roof structure or any space above the
height limit shall be allowed for the purpose of providing additional space
for residential, commercial, or industrial use.
SECTION VIII. All Ordinances or parts of Ordinances in conflict with this Ordinance
are hereby repealed.
