BE IT ORDAINED BY THE AUGUSTA-RICHMOND COUNTY COMMISSION, and it is hereby ordained by authority of same as follows: Section 1. Titles 4 and 5 of the Augusta-Richmond County Code, attached hereto, are hereby adopted in their entirety. Section 2. Section 1-6-1 of the Augusta-Richmond County Code is hereby adopted to provide the penalty for violating the provisions of the Augusta-Richmond County Code, to wit: ~ 1-6-1. GENERAL PENALTY FOR VIOLATION OF CODE, ETC.; CONTINUING VIOLATIONS. Whenever in this Code or in any ordinance of Augusta-Richmond County or any rule or regulation or order promulgated by any officer or agency of Augusta-Richmond County under authority duly vested in him or if any act is prohibited or is made or \ 1 'J I -, declared to be unlawful or an offense or a misdemeanor, or whenever in such Code or ordinance or rule, regulation or order the doing of any act is required or the failure to do any act is declared to be unlawful or an offense or a misdemeanor where no specific penalty is provided therefor, the violation of any such provision of this Code or any such ordinance, rule, regulation or order shall be punished by a fine not exceeding one thousand dollars or by .i,mprisonment not exceeding sixty (60) days, either or both,. in the discretion of the judge of the court having jurisdiction. Each day any violation of any provision of this Code or of any such ordinance or rule, regulation or order shall continue shall constitute a separate offense. Section 3. (a) Uncontrolled storm water drainage/discharge may have a significant, adverse impact on the health, safety, and welfare of the citizens of Augusta- Richmond County. Surface water runoff can carry pollutants and nutrients into receiving wat:ers. . (b) Uncontrolled storm water drainage can increase the incidence of flooding and the level of flcods wnich occur, endangering roads, other public and pri,at:e ~ropert:y and ~uman l~:e. (e) Altered land surfaces can change the rate and volume of runoff. (d) ~dverse wacer cualitv and auantitv conseauences described above could result in substant:ial economic ~osses. Potent:~al losses include, but: are ::.ot: ~i~~ced to, increased wacer treacment costs, as well as st:ate and federal fines associated with wacer qualicy violations. DBi'nnT:IONS. (a) For the purposes af this chapter, unless specifically defined below, words or phrases shall be int:erpret:ed so as to give them the meaning they have in common usage and to give this chapter its most effective application. Words in the singular shall include the plural, and words in the plural shall include t:he s~~ar. Words used in the present tense shall include the future tense. The word sball connotes mandatory and not discretionary; the word may is permissive. (b) Unless otherwise specified, or it is apparent from the context, definit:ions herein will be t::e same as those in other Augusta-Richmond countYi. Ordinances and as used elsewnere in this code. (11 Accidencal discharge. A discharge prohibited by this chapter int:o the munici~al storm sewer syscem which occurs by chance and without: planning or consideration prior t:o occurrence. (2) Aoceals authority, ~he Augusta-Richmond County Commission, one or whose purpose is t:o :-ev~ew appeals to this chapter and render decisions and variances. (3) Bese Managemene Praceices (BMPs). A wide range of management procedures, act:ivit:ies, and prohibitions on pract:ices which control the qualit:y and/or quantity of storm wat:er runoff and which are compatible with the planned land use. In addition, if site characterist:ics indicat:e that: complying with these minimum requirements will not: provide adequate designs or protection for local property or residents, it is the designer's responsibility to exceed the minimum requirement:s as necessary. . 5 5-2-6. ILLICIT CONNECTIONS. (a) It is unlawful for any person, to connect any pipe, open channel, or any other conveyance syst:em that discharges anything except storm water or unpolluced wacer which is approved by the director, based on the exemptions listed in ~ S-1-8(b), to August:a-~ichmond County's storm water system. (b) Improper connect:ions in violation of this Code must be disconnected and rea~rected, if neeessary, to t~e Augusta-Richmond County sanitary sewer syst:em upon approval by the direct:or of the water and sewer department. ~ 5-2-10. MAINTENANCE AND INSPECTION. ,a) ,~y storm wate~ ~agement: facility or 3MP which services a single lot: or cemmercial and induscrial development: shall be privately owned and ~aint:a~~ed. (3) If applicant files no objection to special permit conditions proposed by the Director of Utilities or a subsequent agreement is reached concerning same, the Director of Utilities shall issue a wastewater discharge permit to applicant with such special conditions incorporated therein. Augusta-Richmond County may require, to be provided and operaced at an Industrial User's own expense, monitoring facilities t:o allow inspection, sampling, testing and flow measurement of the building sewer and/or internal drainage systems. The monitoring facility shall normally be situated on the User's premises, but Augusta-Richmond County may, when such a location would be impractical or eause undue hardship to the User, permit the facility to be constructed in the public street or sidewalk area and locat:ed so that it will not be obstructed by landscaping or parked vehicles. The facility, sampling, test:ing and measuring equipment shall be maintained at all times in a safe and proper operating condition at the expense of the User.
