ORDINANCE NO. 5868 AN ORDINANCE TO ESTABLISH SEVERANCE COMPENSATION FOR DISPLACED DEPARTMENT HEADS OF AUGUSTA-RICHMOND COUNTY; TO PROVIDE AN EFFECTIVE DATE; TO PROVIDE FOR REPEAL OF THIS ORDINANCE ON A DATE CERTAIN; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE AUGUSTA-RICHMOND COUNTY COMMISSION- COUNCIL, AS SUCCESSOR TO THE CITY COUNCIL OF AUGUSTA, GEORGIA AND THE BOARD OF COMMISSIONERS OF RICHMOND COUNTY, GEORGIA, AND IT IS HEREBY ORDAINED BY AUTHORITY OF THE SAME AS FOLLOWS: Section 1. There is hereby established severance compensation to be paid to eligible employees of Augusta-Richmond County, upon the following terms and conditions: 1. "Eligible Employees" are those persons (a) classified as of December 31, 1995 as department heads of the City of Augusta or Richmond County, Georgia, including acting department heads, (b) who are eligible, or who, if they were a participant, would have been eligible, for Enhanced Early Retirement under one of the pension plans of the City of Augusta or Richmond County, and (c) who elect such Enhanced Early Retirement if they are a participant under a pension plan", or resign from employment if they are not a participant, on or before December 31, 1996. The following department heads are eligible employees under this ordinance: Richmond County: Ann Barker, Purchasing Linda Beazley, Administrator Tommy ,Boyles, Recreation Henry Brooks, Animal Control Millard Gooding, Publ~c Works Lewis Johnson, Central Services Robert Leverett, RCCI George McElveen, Water & Sewerage Butch McKie, Finance S. Miller Meyer, License & Inspection Alvia A. Murdock, Fire Frank Thomas, Human Relations \, City of Auqusta: Robert E. Anderson, Electrical Dept. Steven T. Atha, Bush Field Charles Dillard, Administrator Sam Fussell, Main Street ~ , , .. '7 " Noah Max Hicks, Waterworks Oper. Eligible employees who terminate their employment with Augusta-Richmond County through retirement or resignation on or before December 31, 1996 will receive a lump sum payment equal to one week's current salary multiplied by the Eligible employee's number of uninterrupted years of service with the City or County; provided, however, that this lump sum amount shall not exceed $25,000.00. 3. In consideration of this severance package, Eligible employees shall enter into a covenant not to sue and release of claims against the City, the County and/or Augusta-Richmond County in a form approved by the County Attorney. Section 2. All laws or ordinances or parts of laws or ordi- nances in conflict with this ordinance are hereby repealed. Section 3. This ordinance is repealed as of January 1, 1997; provided, however, such repeal shall not affect rights vested hereunder. Section 4. This ordinance shall become effective upon adoption. A~~ ~~ r k ,:/7' ~ .... ~ ./~ <~:l:--~~~.-r~'s' .' .:" ....~ . ~ ~~~~ First Reading: f6-~o- Cj~ Cj-j-~6 Second Reading: ~ - ;-- .~ " .' ~ - " ~ PUBLIC NOTICE The public is hereby notified that the County Attorney will present to the Augusta-Richmond County Commission-Council, at its regular meeting on August 20, 1996, and on September 3, 1996, an Ordinance to amend the RETIREMENT PLAN FOR EMPLOYEES OF RICHMOND COUNTY EFFECTIVE JANUARY 1, 1977 so as to substitute the "Augusta-Richmond County Commission-Council" for the "Board of Commissioners of Richmond County" in all references to the Board of Commissioners in said plan; to provide for Enhanced Early Retirement for employees employed on the effective date of this amendment; to repeal conflicting ordinances; to provide an effective date; and for other purposes. The public is further notified that a copy of the proposed Ordinance has been filed with the Clerk of Superior Court of Richmond County, Georgia, City-County Building, 5th floor, 500 block Greene Street, Augusta, Georgia, for public examination and inspection, and copies of same are available with the Clerk of the Commission-Council for any member of the public.
