ORDINANCE NO, 5858 AN ORDINANCE TO ESTABLISH REQUIREMENTS REGARDING COLLECTION OF GRASS, LEAVES, BRUSH, ETC, IN THE URBAN SERVICES DISTRICT, TO ESTABLISH REMEDIES FOR NONCOMPLIANCE; TO PROHIBIT LITTERING OF STREETS AND SIDEWALKS IN THE URBAN SERVICES DISTRICT AND TO ESTABLISH REMEDIES FOR' NONCOMPLIANCE; TO PROVIDE AN EFFECTIVE DATE; TO REPEAL CONFLICTING ORDINANCES; AND FOR OTHER PURPOSES, BE IT ORDAINED BY THE AUGUSTA-RICHMOND COUNTY . - ~ - COMMISSION-COUNCIL AND IT IS HEREBY ORDAINED BY THE AUTHORITY OF SAME AS FOLLOWS: Section 1, Grass, leaves, tree trimmings, etc, (a) Prohibited in streets or gutters, It shall be unlawful to place grass, leaves, shrubbery trimmings, brush, limbs, trees or parts thereof, or any similar materials in the streets or gutters within the Urban Services District, Any person engaged in the business of horticulture or landscape gardening or landscape maintenance such that such materials are created as a result of said business shall be responsible for disposing of said materials, (b) Collection by sanitation department, The sanitation department is responsible for collecting only grass, leaves or shrubbery trimmings and similar materials which is placed in closed containers or bags, ,~ and only brush, limbs, trees or parts thereof, and similar materials which are no more than four feet long and/or four inches in diameter and weigh no more than fifty (50) pounds, all of which are required to be placed in a neat, orderly pile between the curb and sidewalk for collection according to the collection schedule of the sanitation department. (c) Disposal required, Material not eligible for collection by the sanitation department as set out in subsection (b) hereof shall not be collected by the sanitation department and it shall be the responsibli ty of the property owner,. or the person . ., ". engaged in the business ofhorticul ture or landscape gardening or landscape maintenance, to dispose of said material, (d) Cleaning of property at owner's expense; violations. In the. event the sanitation'. department discovers such material on property within the Urban Services District, the sanitation department shall leave a written notice at the property which notifies the owner of his/her responsibility to dispose of the material, or shall provide written notice by mail to the person engaged in :; the business of horticulture or landscape gardening or landscape maintenance, The sanitation department shall keep a record of all such notices delivered, In the event the material is not disposed of according to this Section within fifteen (15) days of said written notice, the sanitation department shall have the option, but shall not be required, to collect and dispose of said material, with the cost of such collection and disposal billed to the property owner or other responsible party, If such cost is not paid by the property owner within ten (10) of the date of billing, then execution may be issued by the Augusta-Richmond County Commission-Council against the property upon which such service is rendered for the cost thereof, and such execu~iori shall constitut~ a lien against the property unti~ __'f~;Lly paid and satisfied. Said execution may be enforbed in the same manner, and with the addition of interest and costs, as provided by law for the enforcement of executions for ad valorem taxes, Any person or party violating this section may be prosecuted in the Municipal Court and, if convicted, punished by a fine not to exceed One Thousand Do"llars ($1,000,00) or up to sixty (60) days in the Augusta- Richmond County jail, or both, in the discretion of the ~ " ,- ..j Municipal Court, Section 2, Litterinq of streets and sidewalks prohibited, It shall be unlawful for any person to place, store, dump, park or broadcast any junk, metal, brickbats, stones, plaster, lumber, trash, garbage, litter, paper or similar rubbish and junk upon any public street or sidewalk in the Urban Services District, As used in this Section, "junk" includes withc5ut: limitation appliances, furniture and other bulk items not considered usual household garbage, The sanitation department is not responsible for collection and/or disposal of such junk, and such junk shall not be collected by the sanitation department, but must be disposed of by the owner of the property on which it is located, Section 3, Cleaning of property at owner's expense; Violations, In the event the s~nitatiorr d~partment discoveis that litter not eligible - for. collection by the sanitation department is placed on private.'prc5perty within the Urban Services District, the sanitation department shall leave a written notice at the property which notifies the owner of his/her responsibility to dispose of the material, The sanitation department shall keep a record cf all such J ' ., notices delivered, In the event said litter is not disposed of according _'to this: s.ect,Io~n--w-ithin fiftE:en' (15) days of said written notice, the_sanitation department - - shall have the option,.. blit'shall not be required, - to collect and dispose of said material, with the cost of such collection and disposal billed to the property owner or other responsible party, If such cost is not paid by the property owner within ten (10) days of the date of billing, then execution may be issued by the Augusta- Richmond County Commission-Council against the property upon which such service is rendered for the cost thereof, and such execution shall constitute a lien against the property until fully paid and satisfied, Said execution may be enforced in the same manner, and with the addition of interest and costs-, _ as provided by law for the enforcement of executions for ad valorem taxes, In addition, any person or party violating this section may be prosecuted in the Municipal Court and, if convicted, punished by a fine not to exceed One Thousand Dollars ($1,000,00) or up to sixty (60) days in the Augusta- Richmond County jail, or both, -in the c:iiscretion of the Municipal Court, - .
