Sf .3 r;o An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County and the city Council of Augusta effective November 15, 1983, entitled "An Ordinance to Readopt and Reconfirm the Comprehensive Zoning Ordinance adopted March 25, 1963, by the Board of Commissioners of Richmond county and the city Council of Augusta, together with all amendments which have been approved by either the Board of Commissioners of Richmond County or the city Council of Augusta as authorized under the Home Rule Provisions of the Constitution of the state of Georgia" by changing the Comprehensive Zoning Map by approving a Plan Modification and a modification of the condition placed on the earlier . rezoning in 1995 (Z-95-100) to Zone R-IE (One-family Residence) per city of Augusta Ordinance 5790 affecting property located on the northwest right-of-way line of Kissingbower Road, 163 feet, more or less, northeast of a point where the northeast r~ght-of-way line of Marschalk Road intersects with the northwest right-of-way line of Kissingbower Road; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA-RICHMOND COUNTY COMMISSION-COUNCIL HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map by approving a Plan Modification and a modification of the condition placed on the earlier rezoning in 1995 (Z-95-100) to Zone R-IE (One-family Residence) per City of Augusta Ordinance 5790 affecting property as follows: Beginning at a point located on the northwest right-of- way line of Kissingbower Road, 163 feet, more or less n~rtheast of a point whe:e the northeast right-of-way Ilne of Marschalk Road 1ntersects with the northwest right-of-way line of Kissingbower Road;, thence N 58005'51" W a distance of 380.53 feet to a point. the~ce N 58041'49" W a distance of 340.55 feet to ~ point: thence, N 58022'50" W a distance of 215.08 feet to ~ point located on the south right-of-way of the Georgia Railroad line; thence, N 85008'00" E along the south .--11!' ,. ... ,"" ~ right-of-way of the Georgia Railroad line a distance of 865.61 feet to a point; thence, S 33056'04" W a distance of 162.97 feet to a point; thence, S 58009'31" E a distance of 268.09 feet. to a point located on the northwest right-of-way line of Kissingbower Road; thence, S 35005'41" W along the northwest right-of-way line of Kissingbower Road a distance of 115.05 feet to a point; thence, N 56041'22" W a distance of 209.29 feet to a point; thence, S 31052'31" W a distance of 105.04 feet to a point; thence, S 58005'51" E a distance of 203.60 feet to a point located on the northwest right-of-way line of Kissingbower Road; thence, S 35005'41" W along the northwest right-of-way line of Kissingbower Road a distance of 131.38 feet to the point of beginning. This property contains 5.62 acres. SECTION II. That this amendment to the Comprehensive zoning Map is subject to the following stipulation: subject to a revised development plan that retains the masonry wall along the south property line.
