ORDINANCE NO. .:J- g' 3/ AN AMENDMENT TO A JOINT ORDINANCE OF THE BOARD OF COMMISSIONERS OF RICHMOND COUNTY AND THE CITY COUNCIL OF AUGUSTA REGULATING THE SALE, SERVICE AND CONSUMPTION OF ALCOHOLIC BEVERAGES WITHIN AUGUSTA-RICHMOND COUNTY; TO PROVIDE FOR THE OPERATION OF BREWPUBS AND BREWERIES UNDER CERTAIN CONDITIONS; TO ESTABLISH LICENSE FEES FOR BREWPUBS AND BREWERIES; TO PROVIDE AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE AUGUSTA-RICHMOND COUNTY COMMISSION- COUNCIL, AND IT IS HEREBY ORDAINED BY AUTHORITY OF SAME AS FOLLOWS: Section 1. Ordinance No. 95-11, adopted by the Board of Commissioners of Richmond County on December 5, 1995, and Ordinance No. ____ adopted by the City Council of Augusta, providing for the licensing and regulation of the sale, service and consumption of alcoholic beverages within Richmond County is hereby amended by adding a new section to be known as Section which shall read as follows: ~ 1.77 LICENSES FOR BREWPUBS AND BREWERIES. 1. Definitions. The following definitions shall apply in the interpretation and enforcement of this Ordinance: (a) Brewpub. Any eating establishment in which beer or malt beverages are manufactured or brewed, subject to the barrel production limitation prescribed in O.C.G.A. ~ 3- 1 '=i 1.\ , '.. 5-36, for retail consumption on the premises and solely in draft form. As used herein, the term Heating establishmentH means an establishment which is licensed to sell distilled spirits, malt beverages, or wines and which derives at least fifty percent (50%) of its total annual gross food and beverages sales from the sale of prepared meals or food. (b) Brewer. A manufacturer of malt beverages. 2. The following licenses are hereby established: Class G - Brewer, Manufacturer of Malt Beverages Class H - Brewpub Operator - $500.00 3. (a) No individual shall be permitted to own or operate a brewpub without first obtaining a proper license from the Augusta-Richmond County Commission- Council, and each brewpub licenseholder shall comply wi th all other applicable state and local license requirements. (b) A brewpub license authorizes the holder of such license to: (1) Manufacture on the licensed premises not more than 5,000 barrels of beer in a calendar year solely for retail sale on the premises and solely 2 :,! ,.~- .. ,- . -; in draft form; and (2) Operate an eating establishment that shall be the sole retail outlet for such beer and may offer for sale any other alcoholic beverages produced by other manufacturers which are authorized for retail sale under licenses issued by the Augusta-Richmond County Commission-Council, including wine, distilled spirits, and malt beverages, provided that such alcoholic beverages are purchased from a licensed wholesaler for consumption on the premises only; and, provided, further, that in addition to draft beer manufactured on the premises, each brewpub licensee shall offer for sale commercially available canned or bottled malt beverages from licensed wholesalers. (c) Possession of a brewpub license shall not prevent the holder of such license from obtaining a retail consumption dealer's license or a retailer's license for the same premises. (d) A brewpub license does not authorize the holder of such license to sell alcoholic beverages by the package for consumption off the premises. (e) A brewpub licensee shall not offer or permit any 3 .. 'I .. -. free sampling of beer by its customers on the premises of a brewpub. (f) A brewpub licensee shall: (1) Pay all state and local license fees and excise taxes applicable to individuals licensed as manufacturers, retailers, and, where applicable, wholesalers under this title; and (2) Measure beer manufactured on the premises and otherwise comply with applicable regulations respecting excise and enforcement tax determination of such beer as required by Georgia law and the Ordinances of Augusta-Richmond County. Section 2. All ordinances or parts of ordinances in conflict with this ordinance are repealed as of the effective date of this ordinance. Section 3. This ordinance shall become effective immediately upon adoption.
