THIS INDENTURE, made this X -;;:Y o~, 2000 by and
RICHMOND COUNTY
between WILLIAM C. HOWARD, JR. of Richmond County, Georgia, as party of the
first part, and AUGUSTA, GEORGIA, a political subdivision of the State of Georgia,
as party of the second part:
WIT N E SSE T H:
That the party of the first part, for an in consideration of the sum of Fifty
Thousand and No/10aths ($50,000) Dollars, cash in hand paid, receipt whereof is
hereby acknowledged, does hereby grant, bargain, sell and convey unto the
party of the second part, its successors and assigns, the following described
property, to wit:
All that tract or parcel of land, with any improvements
thereon, situate, lying and being in Augusta-Richmond
County, Georgia, fronting a distance of sixty (60) feet on the
South side of Broad Street, and being more particularly
shown and described as Parcel "4" (Tax Map 35-2, Parcel
577) on a plat prepared for William C. Howard, Jr., by
Harbin and Associates, dated July 22, 1994. Said plat is
attached hereto and is incorporated herein by reference
thereto for a more complete description as to metes,
bounds, courses and location.

In further consideration for such payment, the party of the first part agrees
to indemnify and hold the party of the second part, its successors and assigns,
forever harmless and from any and all claims, demands, causes of action and
liabilities (including fines and civil penalties), at law or in equity, including but not
limited to any statutory causes of action, including without limitations the
comprehensive Environmental Response Compensation and Liability Act of 1980
(CERCLA) for injury or death, destruction, loss or damage of any kind or
character to the party of the second part, its employees, agents, servants,
representatives, tenants, successors and/or assigns, arising out of or in any way
relating to any actual or alleged spill, leak or discharge which resulted in any
surface or subsurface contamination of said property, including reasonable
attorneys' fees and litigation expenses incurred by the party of the second part in
defense of any such claims or causes of action.
To HAVE AND To HOLD the said parcel of land, together with all rights,
ways and appurtenances thereto belonging or in anywise appertaining unto the
party of the second part, its successors and assigns, in fee simple, forever.
AND the party of the first part does hereby warrant the title to said property
to the party of the second part and will forever defend the same against the
unlawful claims of all persons whomsoever.
