INTRODUCTION
The City of Augusta annually receives funds from the U. S. Department of Housing and Urban
Development (HUD) that includes Community Development Block Grant, HOME Investment
Partnerships, Emergency Shelter Grant, and Housing Opportunities for Persons with AIDS. For
receipt of these funds, the City must submit a 5-year long-range plan known as the Consolidated
Plan. Each year of the five-year plan, the City must develop an Action Plan describing how
funds will be used each year to address the goals and strategies in the 5-year Consolidated Plan.
The American Recovery and Reinvestment Act of 2009 "Recovery Act" was signed into law on
February 17,2009. The purposes ofthe Act include the following:
1. To preserve and create jobs and promote economic recovery;
2. To assist those most impacted by the recession;
3. To provide investments needed to increase economic efficiency by spurring technological
advances in science and health;
4. To invest in transportation, environmental protection, and other infrastructure that will
provide long-term economic benefits; and
5. To stabilize State and local government budgets, in order to minimize and avoid
reductions in essential services and counterproductive state and local tax increases.
Funds were appropriated to stimulate the economy through measures that modernize the nation's
infrastructure, improve energy efficiency and expand educational opportunities and access to
health care.
The Recovery Act includes $1 billion in Community Development Block Grant Recovery
(CDBG-R) funds to support a broad range of housing and community development projects that
should be "shovel-ready" and can be implemented as soon as possible.
The City will receive an allocation of $606,372 in new CDBG-R funds that is a one-time special
allocation of 2008 CDBG funding. HUD requires that the City of Augusta prepare and submit a
Substantial Amendment to its Consolidated Plan 2008 Action Plan that outlines how the City
will use and administer the funds. This document represents the details of the Substantial
Amendment to the Plan.
This is the third amendment to the City of Augusta 2008 Action Plan. This amendment is
necessary to allow the use of additional Community Development Block Grant Recovery funds.
The City must give priority to projects that can award contracts within 120 days and be
completed by September 30, 2012, which is the deadline for use ofCDBG-R funds.

COMMUNITY DEVELOPMENT BLOCK GRANT RECOVERY FUNDS (CDBG-R)
CDBG-R funds enables local governments to undertake a wide range of activities intended to
create a suitable living environment, provide decent affordable housing and create economic
opportunities, primarily for persons of low and moderate income. As specified under the
Recovery Act, the City has given priority for use of the funds to projects that can be awarded
contracts based on bids within 120 days from when HUD signs the City's Grant Agreement.
The City will use funds for three (3) projects that are described in more detail in this document.
HUD has asked staff to consider funding existing projects that are shovel-ready. Priority has
been given to projects that maximizes job creation and provides economic benefit. These
projects include the creation of permanent, temporary and construction jobs that are eligible
under the CDBG-R regulations. Furthermore, these projects can be awarded and ready to bid
within 120 days from the date the funds are made available to the city.
CDBG-R SUBMISSION TEMPLATE
& CHECKLIST
The American Recovery and Reinvestment Act of 2009 ("Recovery Act") was signed
into law by President Obama on February 17,,2009. The Recovery Act awards $1 billion in
CDBG Recovery (CDBG-R) funds to be distributed to cities, counties, insular areas and states,
of which $10 million has been reserved by HUD for its administrative costs and $10 million of
which will be awarded to Indian tribes. Recipients of the remaining $980 million of CDBG-R
funds will be the approximately 1,200 jurisdictions that received CDBG funding in Fiscal Year
2008. This template sets forth the suggested format for grantees receiving funds from CDBG-R.
A complete submission contains the information requested below, including:

(2) Spreadsheet for Reporting Proposed CDBG-R Activities

ENSURING RESPONSIBLE SPENDING OF RECOVERY ACT FUNDS
Funding available under the Recovery Act has clear purposes - to stimulate the economy through
measures that modernize the Nation's infrastructure, improve energy efficiency, and expand
educational opportunities and access to health care. HUD strongly urges grantees to use_ CDBG-
R funds for hard development costs associated with infrastructure activities that provide basic
services to residents or activities that promote energy efficiency and conservation through
rehabilitation or retrofitting of existing buildings. While the full range of CDBG activities is
available to grantees, the Department strongly suggests that grantees incorporate consideration of
the public perception of the intent of the Recovery Act in identifying and selecting projects for
CDBG-R funding.
A. SPREADSHEET FOR REPORTING PROPOSED CDBG-R ACTIVITIES
Grantees must provide information concerning CDBG-R assisted activities in an electronic
spreadsheet provided by HUD. The information that must be reported in the spreadsheet
includes activity name, activity description, CDBG-R dollar amount budgeted, eligibility
category, national objective citation, additional Recovery Act funds for the activity received
from other programs, and total activity budget. An electronic copy of the spreadsheet and the
format is available on HUD's recovery website at http://www.hud.gov/recovery.

B. CDBG-R INFORMATION BY ACTIVITY (COMPLETE FOR EACH ACTIVITY)

In addition to the Spreadsheet for Reporting Proposed CDBG-R Activities, grantees must
provide a narrative for each activity describing how the use of the grantee's CDBG-R funds will
meet the requirements of Title XII of Division A and Section 1602 of ARRA. The grantee's
narrative must also state how CDBG-R funds will be used in a manner that maximizes job creation
and economic benefit in relation to the CDBG-R funds obligated, and will address the Recovery Act,

ACTIVITIES
1. Activitv Name: LANEY-WALKER ENTERPRISE INITIATIVE
Activitv Narrative: This project will be administered by Antioch Ministries, a local faith-based
non-profit Community Based Development Organization (CBDO). The project involves the
construction of a 4,950 square feet new 2-story facility to be located at the corner of Laney-
Walker Boulevard and Blount Avenue in the Laney-Walker neighborhood. The facility has a
three-fold purpose and will be used as:
a. Micro-Enterprise Development
Training will be provided to micro-enterprise businesses consisting of classes in business plan
development, business skills, credit repair, marketing, financial management, and provision of
one-on-one technical assistance. Micro-loans will be available to clients with follow-up and
post loan assistance.
b. Business Incubator
The Business Incubator will be designed to assist new entrepreneurs in successfully growing
their small businesses by providing low cost space, office support services and business
management assistance. Other services to include planning, accounting, marketing and
financing, access to copier and fax machines, high-speed Internet access, computer lab,
receptionist and fully serviced office space will be provided.
c. Neighborhood Network Center
This component will provide an opportunity for education, training, supportive services and
connections to the surrounding community for area residents. Area residents will have access to
current, top-quality technological resources in which they can become self-sufficient by
improving employability and connecting with people and resources within the community.
This activity meets the requirements of Title XII of Division A and Section 1602 of ARRA
because this activity can be let for bid within 120 days from the date the funds are made
available. The architectural plans and specifications are complete, contract documents are. in
place and the activity has been let for bid once. Because of a lack of funds, this activity could
not proceed. This activity will be rebid July 2009 and the contract is expected to be awarded
August 2009, with construction commencing September 2009.
The $400,000 in CDBG-R funds invested in this project will increase economic efficiency in the
Laney-Walker neighborhood by creating 57 full time jobs for low income persons; thereby
assisting those most impacted by the recession and promoting economic recovery in this
neighborhood.

The Laney-Walker neighborhood is a low income neighborhood recently designated by HUD as
a Neighborhood Revitalization Strategy Area (NRS) which also includes Bethlehem
neighborhood. Also, because of the distressed conditions of the neighborhood, Laney-Walker
neighborhood was designated an Enterprise Zone five years ago. An enterprise zone is a
geographic area which is suffering from disinvestment, underdevelopment and general economic
distress. In an effort to encourage revitalization in distressed communities, the Georgia General
Assembly enacted the Enterprise Zone Employment Act of 1997, to induce the investment of
private resources in productive business enterprises located in the designated area.
Population: There are approximately 3,762 residents in Laney-Walker with 79% being low to
moderate income persons. The neighborhood is located in Census Tracts 7 and 9.
Housing Conditions: Residents of this neighborhood suffer from poor housing conditions. Of
the 1,284 structures in the neighborhood, 235 houses are in poor condition, 131 houses in
deteriorated condition (structural and need of major repairs), 115 houses in dilapidated condition
(uninhabitable and should be demolished), 456 vacant lots and 284 vacant buildings.
Employment: There is a high unemployment rate in Laney-Walker neighborhood. For year
2007, it is estimated that 83.8% are employed, 13.4% unemployed and 1.3% in the Armed
Forces. These percentages have increased during year 2009. The City's Housing Rehabilitation
Program has noted an increase in small contractors looking for construction work, willing to do
lower level construction work, thus illustrating the need for construction and trade worker jobs.
The jobs to be created as a result of this project will greatly contribute to the economic recovery
of the Laney - Walker neighborhood.

Additional Activity Information: For construction of this facility, construction materials will
include energy efficient windows, insulation and Energy Star products. Using super insulated
walls and high energy-efficient windows will dramatically reduce the amount of energy needed
to operate the incubator/center.
Smart growth is an urban planning and transportation theory that concentrates growth in the
center of a city to avoid urban sprawl; and advocates compact, transit-oriented, walkable,
bicycle-friendly land use, including neighborhood schools, complete streets, mixed-use
development with a range of housing choices.
As mentioned above, this activity is located in the Laney-Walker neighborhood, which is located
in the inner city. In very close proximity to this neighborhood are:

Activity Name:
CLEARANCE AND DEMOLITION
Activity Narrative: This activity involves the demolition and clearance of a structure. The
structure is a 16-unit dilapidated single story apartment complex located at 910 Wrightsboro
Road in the Laney-Walker neighborhood. The City has acquired the property and proposes to
demolish the structure. Upon completion of demolition and clearance, the land will be used for
future redevelopment of the Laney-Walker area within the next 120 days.
This activity meets the requirements of Title XII of Division A and Section 1602 of ARRA by
being "shovel-ready" with bids to be let within 120 days from the date the funds are made
available. It is anticipated that the contract for demolition will be awarded July 2009 and
construction completed by August 2009.
This project is located in the same distressed Laney-Walker neighborhood as the Laney-Walker
Enterprise Initiative activity aforementioned. This investment in this neighborhood will provide
long-term economic benefits while at the same time providing construction jobs for contractors
who have been greatly impacted by the recession.

Activity Narrative: Funds will be used to provide a loan to assist one small business which is
located in the Laney-Walker neighborhood. The loan proceeds will be used to purchase
equipment for the business.
This activity meets the requirements of Title XII of Division A and Section 1602 of ARRA by
investing in this business, which is located in a low income neighborhood, will provide long-
term economic benefits while at the same time providing jobs for low income persons, with
additional benefits of fostering energy efficiency by using Energy Star equipment. Once the
funds are available, the equipment will be purchased and installed within 120 days.

C. PUBLIC COMMENT
Provide a summary of public comments received to the proposed CDBG-R Substantial
Amendment.
Note: A Proposed CDBG-R Substantial Amendment must be published via the usual methods
and posted on the jurisdiction's website for no less than 7 calendar days for public comment.
Response:
According to the CDBG-R Program notice issued May 5, 2009, HUD is waIvmg the
Consolidated Plan regulations to the extent necessary to adjust the reporting requirements for the
use of CDBG-R funds to comply with the Recovery Act. The waivers and alternative
requirements provide expedited program implementation and implement statutory requirements
unique to this supplemental appropriation.
In the regular CDBG program, the City is required to provide 30 calendar days for soliciting
comments from its citizens before it submits an annual action plan to HUD. Then, HUD has 45
calendar days to accept or reject the plan. To expedite the process and to ensure that the CDBG-
R grants are awarded in a timely manner, while preserving a reasonable citizen participation
process, HUD is waiving the requirement that the City follow its citizen participation plan for
this substantial amendment. HUD is shortening the minimum time for citizen comments to seven
(7) calendar days and requiring the substantial amendment materials to be posted on the City's
official website as the materials are developed, published, and submitted to HUD.
In compliance with the CDBG-R notice for citizen participation, the Citizen's Participation
process was expedited due to the importance of providing immediate economic stimulation. The
process included the following steps:

CERTIFICATIONS
(1) Affirmatively furthering fair housing. The jurisdiction will affIrmatively further fair housing,
which means that it will conduct an analysis to identify impediments to fair housing choice within the
jurisdiction, take appropriate actions to overcome the effects of any impediments identifIed through that
analysis, and maintain records reflecting the analysis and actions in this regard.
(2) Anti-displacement and relocation plan. The jurisdiction will comply with the acquisition and
relocation requirements of the Uniform Relocation Assistance and Real Property Acquisition Policies Act
of 1970, as amended (42 U.S.C. 4601), and implementing regulations at 49 CFR part 24; and it has in
effect and is following a residential anti-displacement and relocation assistance plan required under
section 104(d) of the housing and Community Development Act of 1974, as amended, in connection with
any activity assisted with funding under CDBG-R.
(3) Drug Free Workplace. The jurisdiction will or will continue to provide a drug-free workplace by:
1. Publishing a statement notifying employees that the unlawful manufacture, distribution,
dispensing, possession, or use of a controlled substance is prohibited in the grantee's workplace
and specifying the actions that will be taken against employees for violation of such prohibition;
2. Establishing an ongoing drug-free awareness program to inform employees about-
(a) The dangers of drug abuse in the workplace;
(b) The grantee's policy of maintaining a drug-free workplace;
(c) Any available drug counseling, rehabilitation, and employee assistance programs; and
(d) The penalties that may be imposed upon employees for drug abuse violations
occurring in the workplace;
3. Making it a requirement that each employee to be engaged in the performance of the grant be
given a copy of the statement required by paragraph 1;
4. Notifying the employee in the statement required by paragraph I that, as a condition of
employment under the grant, the employee will -
(a) Abide by the terms ofthe statement; and
(b) Notify the employer in writing of his or her conviction for a violation of a criminal
drug statute occurring in the workplace no later than fIve calendar days after such
conviction;
5. Notifying the agency in writing, within ten calendar days after receiving notice under
subparagraph 4(b) from an employee or otherwise receiving actual notice of such conviction.
Employers of convicted employees must provide notice, including position title, to every grant
offIcer or other designee on whose grant activity the convicted employee was working, unless the
Federal agency has designated a central point for the receipt of such notices. Notice shall include
the identifIcation number(s) of each affected grant;
6. Taking one of the following actions, within 30 calendar days of receiving notice under
subparagraph 4(b), with respect to any employee who is so convicted:
(a) Taking appropriate personnel action against such an employee, up to and including
termination, consistent with the requirements of the Rehabilitation Act of 1973, as
amended; or

(b) Requiring such employee to participate satisfactorily in a drug abuse assistance or
rehabilitation program approved for such purposes by a Federal, State, or local health,
law enforcement, or other appropriate agency;
7. Making a good faith effort to continue to maintain a drug-free workplace through
implementation of paragraphs 1,2,3,4,5 and 6.
(4) Anti-lobbying. To the best of the jurisdiction's knowledge and belief:
I. No Federal appropriated funds have been paid or will be paid, by or on behalf of it, to any
person for influencing or attempting to influence an officer or employee of any agency, a Member
of Congress, an officer or employee of Congress, or an employee of a Member of Congress in
connection with the awarding of any Federal contract, the making of any Federal grant, the
making of any Federal loan, the entering into of any cooperative agreement, and the extension,
continuation, renewal, amendment, or modification of any Federal contract, grant, loan, or
cooperative agreement;
2. If any funds other than Federal appropriated funds have been paid or will be paid to any person
for influencing or attempting to influence an officer or employee of any agency, a Member of
Congress, an officer or employee of Congress, or an employee of a Member of Congress in
connection with this Federal contract, grant, loan, or cooperative agreement, it will complete and
submit Standard Form-LLL, "Disclosure Form to Report Lobbying," in accordance with its
instructions; and
3. It will require that the language of paragraph I and 2 of this anti-lobbying certification be
included in the award documents for all subawards at all tiers (including subcontracts, subgrants,
and contracts under grants, loans, and cooperative agreements) and that all subrecipients shall
certify and disclose accordingly.
(5) Authority of Jurisdiction. The jurisdiction possesses the legal authority to carry out the programs
for which it is seeking funding, in accordance with applicable HUD regulations and other program
requirements.
(6) Consistency with Plan. The housing activities to be undertaken with CDBG-R funds are consistent
with its consolidated plan.
(7) Section 3. The jurisdiction will comply with section 3 of the Housing and Urban Development Act
of 1968 (12 U.S.c. 170Iu), and implementing regulations at 24 CFR part 135.
(8) Community development plan. The jurisdiction certifies that the consolidated housing and
community development plan identifies housing and community development needs and specifies both
short-term and long-term community development objectives that have been developed in accordance
with the primary objective ofthe statute authorizing the CDBG program.
(9) Following a plan. The jurisdiction is following a current consolidated plan that has been approved
by HUD.
(10) Use of funds. The jurisdiction has developed activities so as to give the maximum feasible priority
to activities that will benefit low- and moderate-income families or aid in the prevention of slums or
blight. Additional activities may be included that are designed to meet other community development
needs having particular urgency because existing conditions pose a serious and immediate threat to the
health or welfare of the community where other financial resources are not available to meet such needs
It has complied with the following criteria:

1. Maximum Feasible Priority. With respect to activities expected to be assisted with CDBG-R
funds, it certifies that it has developed its Action Plan so as to give maximum feasible priority to
activities which benefit low and moderate income families or aid in the prevention or elimination
of slums or blight. The Action Plan may also include activities which the grantee certifies are
designed to meet other community development needs having a particular urgency because
existing conditions pose a serious and immediate threat to the health or welfare ofthe community,
and other financial resources are not available);
2. Special Assessments. The jurisdiction will not attempt to recover any capital costs of public
improvements assisted with CDBG-R funds by assessing any amount against properties owned
and occupied by persons of low- and moderate-income, including any fee charged or assessment
made as a condition of obtaining access to such public improvements. However, if CDBG-R
funds are used to pay the proportion of a fee or assessment attributable to the capital costs of
public improvements (assisted in part with CDBG-R funds) financed from other revenue sources,
an assessment or charge may be made against the property with respect to the public
improvements financed by a source other than CDBG-R funds. The jurisdiction will not attempt
to recover any capital costs of public improvements assisted with CDBG-R funds, unless CDBG-
R funds are used to pay the proportion of fee or assessment attributable to the capital costs of
public improvements financed from other revenue sources. In this case, an assessment or charge
may be made against the property with respect to the public improvements financed by a source
other than CDBG-R funds. In addition, with respect to properties owned and occupied by
moderate-income (but not low-income) families, an assessment or charge may be made against
the property with respect to the public improvements financed by a source other than CDBG-R
funds ifthe jurisdiction certifies that it lacks CDBG-R or CDBG funds to cover the assessment.
(11) Excessive Force. The jurisdiction certifies that it has adopted and is enforcing: (1) a policy
prohibiting the use of excessive force by law enforcement agencies within its jurisdiction against any
individuals engaged in non-violent civil rights demonstrations; and (2) a policy of enforcing applicable
State and local laws against physically barring entrance to or exit from a facility or location that is the
subject of such non-violent civil rights demonstrations within its jurisdiction.
(12) Compliance with anti-discrimination laws. The CDBG-R grant will be conducted and
administered in conformity with title VI of the Civil Rights Act of 1964 (42 D.S.C. 2000d), the Fair
Housing Act (42 D.S.C. 3601-3619), and implementing regulations.
(13) Compliance with lead-based paint procedures. The activities concerning lead-based paint will
comply with the requirements of part 35, subparts A, B, J, K, and R of this title.
(14) Compliance with laws. The jurisdiction will comply with applicable laws.
(15) Compliance with ARRA. The jurisdiction will comply with Title XII of Division A of the
American Recovery and Reinvestment Act of 2009.
(16) Project selection. The jurisdiction will select projects to be funded, by giving priority to projects
that can award contracts based on bids within 120 days from the date the funds are made available to the
recipient, and that will ensure maximum job creation and economic benefit.
(17) Timeliness of infrastructure investments. When the jurisdiction uses CDBG-R funds for
infrastructure investments, the grantee will give preference to quick-start and finish activities, including a
goal to use at least 50 percent of the funds for activities within 120 days of enactment of the Recovery
Act.

(18) Buy American provision. The jurisdiction will ensure that all iron, steel and manufactured goods
used in construction, alteration, repair, or maintenance of a public building or public work project assisted
with CDBG-R funds under the Recovery Act must be produced in the United States unless the Secretary
finds that: (1) the requirement is inconsistent with public interest; (2) those goods are not reasonably
available or produced in sufficient quantity in the U.S.; (3) or the use of the goods will increase the
project cost by more than 25 percent.
(19) Appropriate use of funds for infrastructure investments. The Governor, mayor, or other chief
executive, as appropriate certifies, that any infrastructure investments have received the full review and
vetting required by law and that the chief executive accepts responsibility that the infrastructure
investment is an appropriate use of taxpayer dollars. Alternatively, a grantee's chief elected official
certifies that infrastructure investments will receive the full review and vetting required by law and that
the chief executive accepts responsibility that the infrastructure investment is an appropriate use of
taxpayer dollars.
(20) 70% of CDBG-R for LMI. The aggregate use of CDBG-R funds shall principally benefit persons
of low and moderate income in a manner that ensures that at least 70 percent of the grant is expended for
activities that benefit such persons over the life of the CDBG-R grant.

A RESOLUTION AUTHORIZING SUBMISSION OF AN APPLICATION TO THE U.S.
DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR $606,372 IN COMMUNITY
DEVELOPMENT BLOCK GRANT - RECOVERY FUNDS AND GRANTING THE MAYOR THE
AUTHORITY TO GIVE ASSURANCES AND CERTIFICATIONS AS REQUIRED BY THE
SECRETARY OF THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT AND
GRANTING THE AUTHORITY TO EXECUTE THE GRANT AGREEMENT FOR PROJEcrS AS
APPROVED.

WHEREAS, Augusta-Richmond County has availed itself of the provisions of the American
Recovery and Reinvestment Act of 2009; and
I
WHEREAS, the U. S. Department of Housing and Urban Development CHUD) informed the
City of Augusta that under the American Recovery and Reinvestment Act that the City is eligible to
receive $606,372 in Community Development Block Grant Recovery CCDBG-R) funds; and
I
WHEREAS, HUD regulations relative to the CDBG-R funds require a citizen participation
process that includes a 7-day comment period and that the City complete a substantial amendment;
and
I
WHEREAS, to satisfy HUD's requirements as specified in the CDBG-R regulations, the
substantial amendment was posted on the City's website and was approved by the Augusta-
Richmond County Commission on June 2, 2009; and
I
WHEREAS, in order to expedite the orderly execution of the assurances, certifications and
Grant Agreement, the Mayor is hereby given authority to provide such assurances, certifications and
execute the Grant Agreement as required by the Secretary; and
I
WHEREAS, in order to expedite the federal CDBG-R Program, the Housing and Community
Development Department is given the authority to carry out the program as approved by the
Augusta-Richmond County Commission; and
I
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and the Housing and Community
Development Department be authorized to amend the 2008 Action Plan, prepare and submit the
CDBG- R application, thereto as well as provide the required assurances, certifications, and execution
of the Grant Agreement; and '
I
BE IT FURTHER RESOLVED: That the Housing and Community Development Department
be authorized to carry out the orderly execution of the CDBG-R Program as approved by the
Augusta-Richmond County Commission in compliance with all applicable law, rules, and
regulations.
