RIGHT OF ENTRY
THIS INDENTURE, made and entered into this If? day of C2..t:l:'2001, between Robert
G, Brown, hereinafter referred to as OWNER and Augusta, Georgia, a political subdivision under the laws
of Georgia, hereinafter referred to as AUGUSTA;
WITNESSETH, that the Owner, for and in consideration of the sum of ONE DOLLAR ($1.00), in
hand and truly paid by Augusta, at and before the sealing and delivery of these presents, the receipt
whereof is hereby acknowledged and other valuable consideration, has granted Augusta, its successors
and assigns, the right to enter the following described property:
PARCEL ID #: 110-1-070-01-0
being delineated and more particularly described on a plat prepared by James G. Swift & Associates,
dated 1/7/99, revised 9/14/00 and 7/16/01, attached hereto and made a part hereof, to which reference is
made for a more accurate and complete description of the metes, bounds and courses.
SAID RIGHT OF ENTRY is for the purpose of expediting the completion of the project known as:
10725 Peach Orchard Road 12 Inch WM Replacement
and will terminate upon the completion of the project. This document by no means affects future
negotiations between Augusta and Owner and does not.affect Owner's legal rights to receive payment of
compensation,
SAID RIGHT OF ENTRY being contingent on the following special provisions:
The contractor shall maintain accessibility to the property via one of the driveways at all times.
The existing water service, with back flow prevention device, shall be reconnected to the new water line
by the contractor at no cost to the owner.
All existing buried utility services shall be maintained and/or repaired by the contractor if disturbed.
~he owner shall be provided construction scheduling prior to entering the property.
No construction shall be permitted on site prior to December 27, 2001.
