COUNTY OF FULTON
AMENDMENT TO ARTICLES OF AGREEMENT
THIS AMENDMENT to an Agreement for Project Grant No. NRT-96(5).l dated the 20th
day of September, in the year NINETEEN HJJNDRED NINETY-SIX (1996), made and entered into
this ~day of )' ~""V\~'fI ' 2001;1iVknd between the Department of Natural Resources
(hereinafter DEP ARTMEN ), whose address is 2 Martm Luther Kmg, Jr. Dnve, S. E., SUIte 1352,
Atlanta, Georgia 30334, acting for and on behalf of the State of Georgia, and Augusta-Richmond
County Commissi('ll-Council, (hereinafter referred to as the GRANTEE), whose address is 530
Greene Street, Augusta, Georgia 30911.
WITNESSETH:
WHEREAS, the purpose of the original agreement between the parties was for new trail
construction and bike lane, development of new handicapped ramps and trail-side or trail head
facilities at New Bartram Trail; and
WHEREAS, the DEPARTMENT allocated grant funds in the amount of THIRTY
THOUSAND DOLLARS ($30,000) from the Georgia Recreational Trails Fund to assist the
GRANTEE with the above project; and
WHEREAS, due to other funds needed to complete the project, the GRANTEE has been
unable to proceed with the recreational improvements as specified in the ARTICLES OF
AGREEMENT and theAMENDMENT TO ARTICLES OF AGREEMENT, dated September 5,
2000; and
WHEREAS, the GRANTEE has made a request to the DEP AR TMENT to extend the grant
period from June 30, 2001 to December 31,2002;
NOW, THEREFORE, in consideration of the request from the GRANTEE and the premises,
conditions and convenants set forth in the original AGREEMENT, the parties agree to amend said
AGREEMENT as follows:
1) The Project period shall be retroactively extended from June 30, 2001 to December
31,2002;
2) The GRANTEE and DEPARTMENT mutually agree that all other terms and
conditions of the original agreement shall be and remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this AMENDMENT, to be given
effect as the day and year first above written.
