Stephen E. Shepard. Steve was born in Atlanta, Georgia and moved to Augusta in 1976. He
graduated from Davidson College (A. B, 1973) and the University School of Law, J.D., 1976. He
has been admitted to practice in the Superior and State Courts, the United States District Court for
the Southern District of Georgia, the Georgia Supreme Court and Georgia Court of Appeals since
1976. In 1981 he was admitted to practice in the United States Court of Appeals for the Eleventh
Circuit and in 1983 in the United States Supreme Court. He has a general civil law practice with
emphasis on litigation and personal injury, divorce and probate. He has served on Augusta City
Council and is a sitting member of the Augusta-Richmond County Commission and has previously
served on several public boards including the Board of Trustees of the Augusta Public Library, the
General Aviation Commission and the Red Cross Board. He and his wife Kathie have three
daughters, Brooke (25), Whitney (20), and Mallory (16).
James T. Plunkett. Jim is a life-long resident of Augusta and graduated from Wests ide High School.
After attending Augusta College for one year, Jim attended the University of Georgia and received a
BBA in Finance. He attended the University of Georgia School of Law and graduated cum laude in
1987. While he has a general law practice, his practice focuses on business, probate, real estate and
franchise matters. He and his wife Mary Anne have three daughters, Mary Rob (14), Frances (10)
and Anna (6).
Daniel W. Hamilton. Dan grew up in North Carolina and attended public schools in Alamance
County. Dan received a BA, cum laude, from Appalachian State University. He graduated from the
Mercer School of Law in 1989. Dan is a former assistant prosecutor for the Augusta Judicial Circuit.
While he has a general law practice, his practice focuses on civil litigation, employment and
discrimination law and domestic relations. He and his wife Beth have two children, Thomas (10),
and Elizabeth (8).
Todd M. Boudreaux. Todd moved to Augusta during his elementary school years and graduated
from Alleluia High School. Todd attended the University of Georgia and received a BBA in
Finance. He attended the University of Georgia School of Law and graduated cum laude in 1994.
While he has a general law practice, his practice focuses on debtor and creditor bankruptcy, litigation
and criminal matters. He and his wife Nikki and have three children, Jack (9), Ashley (7) and
Courtney (3).
J. Andrew Tisdale. Andy moved to during his elementary school years and graduated from Augusta
Prep. High School. Andy attended the University of Georgia and received a BA in 1989. He
received a Masters in Divinity in 1994 from Gordon Conwell Theological Seminary, a Masters in
Theology from Harvard University in 1998, and graduated from Florida State University School of
Law in 1999. While he has a general law practice, his practice focuses on civil and construction
litigation, criminal law and domestic relations. He and his wife Holly and have two children,
William (2) and Ava (7 months).

Dear Ms. Bonner:
Please consider this as my "Letter of Interest" to serve as legal counsel for the Augusta
Commission representing the Augusta-Richmond County Commission.
For your review I am enclosing a copy of my resume detailing my professional
qualifications and experience. Please note I have in the past worked as the Assistant
County Attorney for the Augusta Commission, being appointed to the position in the
early days of the consolidated government. In my role as Assistant County Attorney I
provided representation "in and out" of court.
Additionally, I served in the Georgia General Assembly, in the House representing
Augusta Richmond County. During my tenure in the legislature I worked closely with
the Augusta Commission in the governing process.
As you can see my prior experience uniquely qualifies me to serve as legal counsel for
the Augusta Commission representing the Augusta-Richmond County Government.
I am also enclosing herein a detailed compensation proposal for your consideration.

PROPOSED COMPENSATION PACKAGE
A monthly retainer is to be paid in the amount ofTen Thousand ($10,000.00)
Dollars. This retainer will be paid out to cover attorney fees generated by the fee scale
stated herein, and costs incurred by representation.
For legal work done, attorney fees are to be paid at the hourly rate of Two
Hundred ($200.00) Dollars for work done in court, and One Hundred Fifty ($150.00)
Dollars for work done out of court. Any work done by a paralegal is to be paid at the
hourly rate of Forty-Five ($45.00) Dollars.
This pay scale is for.routine legal services; for other special circumstances, i.e.,
Bond Issues, compensation will be determined by negotiation and agreement for the
special circumstance.
Additionally, the Commission is to provide compensation for expenses associated
with legal services for the government, to include (but not limited to):
1) secretarial services payable at cost;
2) a phone line (at cost);
3) transportation cost at the rate established as acceptable by the Internal
Revenue Service (IRS); and
4) copying costs at rate of twenty-five ($.25) cents per page.
As attorney fees are generated and costs incurred, same will be assessed against
the monthly retainer.

et al vs. Richmond County Board of Education, the purpose of the lawsuit
is to desegregate the Richmond County, Georgia School System. (case is

lawsuit was to have all defendants before the City Court to be accorded

Dear Ms. Bonner:
Pursuant to your notice published December 7, 2003, this letter is to
notify you that I am interested in being selected to serve as legal counsel for the
Augusta-Richmond County Government.
As you know, members of my law firm, Capers, Dunbar, Sanders and
Bruckner, and I have extensive knowledge and experience with legal issues
affecting local governmental entities by virtue of the fact that we represented the
City of Augusta in such matters for more than ten years immediately prior to its
consolidation with Richmond County. Following consolidation, members of my
law firm and I continued to represent the consolidated government as successor
to the former city government in a number of lawsuits and other legal matters
which had been pending for some time prior to consolidation. As you know,
these matters were ultimately resolved favorably insofar as the consolidated
government was concerned.
Members of my law firm and I are experienced in drafting ordinances and
resolutions and providing advice and consultation concerning procedural and
substantive legal issues which arise during public meetings. We have
considerable legal experience with regard to litigation of legal matters involving
governmental entities. Lawsuits which we have handled on behalf of
governmental entities included a wide variety of claims for personal injury and
property damage in both state and federal courts, claims involving personnel
disputes under both state and federal law, matters involving taxation, business
licenses, building and utility regulation, contract disputes, environmental
disputes, legal issues involving operation of fire and police departments, waste
water treatment plants and waterworks facilities and legal issues related to
planning, zoning and land development.
I also have extensive experience in construction contract matters, having
represented not only governmental entities, but also private owners, contractors,
architects, and engineers. Such matters include negotiation of construct
contracts as well as representing clients in litigation involving construction
contract disputes. On occasion, I have been deputized by the Attorney General
of the State of Georgia and called upon to represent the State of Georgia in
construction contract disputes in Atlanta and other areas. For many years, I
have been one of a small group of attorneys selected from throughout the
United States who are invited to meet annually to suggest revisions to the
standard form of construction contract documents and endorsed for use by the
American Institute of Architects and The National Society of Professional
Engineers. These are the basic contract documents in regular use throughout
the building construction industry. It seems to me that such experience may be
particularly important in the near future due to plans to construct a new
Courthouse facility.
I have also had extensive experience in representing Augusta as well as
other governmental entities in the acquisition of land and rights of way required
for public purposes such as roads, bridges, public buildings, parks, water and
sewer lines and other public improvements. I have had experience in all three
methods of land acquisition or "condemnation" through the exercise of eminent
domain. Since publiC works frequently require the exercise of eminent domain to
acquire the property necessary for the construction, it is imperative that legal
counsel for a governmental entity have a thorough knowledge and
understanding of such procedures.
Because the legal issues with which local governments such as yours are
confronted on a daily basis are so diverse, it will be difficult to find someone with
the experience necessary to replace Jim Wall because throughout the State of
Georgia there are only a handful of attorneys who have such experience. I
believe that by virtue of the experience that my firm and I have had, we could
assure a smooth transition of the legal matters of the Augusta-Richmond County
Government and afford you the high quality legal representation to which you
have become accustomed.
In your notice you mention that interested persons should submit a
compensation proposal. Rather than submit a separate compensation proposal
with which you may not be familiar, the members of my firm and I will agree to
serve as legal counsel for the same compensation as Mr~ Wall and the members
of his firm are being paid. In other words, our compensation proposal is that we
be compensated on the same basis upon which you are compensating your
current legal counsel.
I trust the foregoing information, together with the enclosed excerpt from
the publishers of the Martindale-Hubbell Law Directory containing a listing of the
education and professional qualifications of the members of my law firm, should
provide you with all of the information that you requested, however, should you

Dear Mayor Young and Members of the Commission:
Please accept this correspondence as my letter of interest for the position of representing
the Augusta-Richmond County Consolidated Government as its legal counsel. For that purpose,
enclosed is a resume.
Pursuant to the notice advertising the position, let me summarize my qualifications. I
received a B.A. Degree in Business from Vanderbilt University. In 1973 I graduated from the
University of Georgia law school. I then joined Harris, Chance, and McCracken. I was made a
partner, and the firm became Hanis, Chance, McCracken, Pickett and Jackson. While with the
finn, I drafted legislative enactments for the senior partners and represented the Richmond
County Tax Assessor's office in a tax case involving Columbia Nitrogen (now DSM).
Additionally, I have represented the Sheriff, the Clerk of Court, and the Chief Tax Assessor of
Augusta, Georgia. In 1982, I was appointed City Attorney for Augusta, Georgia. After serving as
the City Attorney, I formed my own law practice in Augusta. During my representation of the
City and the Sheriff, I never lost a case for them.
I have published The Reincorporation Problem: Form a Limited Partnership and Carry
on Business as Usual in the Georgia State Bar Journal in 1974 and a book, How to Proceed in
Business - Legally, published nationally by Prentice Hall. I have conducted professional seminars
for businesses throughout the Southeast and am an adjunct professor at the Medical College of
Georgia teaching business and regulatory compliance.
Concerning issues that pertain to Augusta Georgia, I have recently represented the 1949
Pensioners and a paving contractor before the City of Augusta. Other pertinent issues addressed
in my practice have included employment discrimination, labor, pension rights, jail conditions,
excessive force claims, environment law, bidding and supply requirements, and the federal
Employee Retirement Income Security Act (ERISA).
Augusta Georgia is the second largest city in Georgia. The budget exceeds $485 million
and the risk management budget exceeds $2 million. Augusta-Richmond County Georgia
deserves to have as its chief legal counsel the upmost lawyer available. While one can skimp on a
legal compensation package for the City attorney position, to do so would be to attract mediocre
lawyers instead of the best available. I am rated "A V" ("Very High to Preeminent") by
Martindale-Hubbell which rates lawyers by inquiry of their peers. Currently, my hourly rate is
over an amount of that would be acceptable to a public body. However for a one year contract as
City Attorney, I would be willing to accept $375 per meeting plus $250 per hour for additional
work. Alternatively, I would be willing to accept the amount Mr.Wall and his staffwere paid
during his last year as City Attorney. Additionally, should the commission be willing to reimburse
for my office support staff, then I would be willing to reduce the quoted hourly rate.
I believe that my experience would be an asset to the Augusta-Richmond County
Consolidated Government which would bring benefits far beyond the cost of providing the legal
servIce.
