PARTIAL RELEASE
FOR GOOD AND VALUABLE CONSIDERATION, Georgia Bank and Trust Company of
Augusta joins in this conveyance for the purpose of releasing and quitclaiming all of its right, title
and interest in and to the Security Deed from HomeSites, Ltd. to Georgia Bank and Trust
Company of Augusta dated February 29, 2000, and recorded in the office of the Clerk of the
Superior Court of Richmond County, Georgia, at Realty Book 679, page 296, et seq.; said Security
Deed being satisfied pro tanto only as to the property consisting of 2.07 acres in fee simple; 18,831
square feet, in permanent easement and 9,403 square feet, in temporary construction
easement, as more fully described in the Plat dated December 10, 2002 describing the property to
be conveyed by HomeSites, Ltd, to Augusta, Georgia and attached hereto as Exhibit "A". The
above referenced Security Deed shall remain in full force and effect as to the remaining property
described therein.

WARRANTY DEED
STATE OF GEORGIA
COUNTY OF RICHMOND
THIS INDENTURE, made the 21st day of May in the year two thousand and
three, between HomeSites Ltd" also known as Home Sites, Ltd., a Georgia Limited
Partnership, hereinafter referred to as the Grantor and Augusta, Georgia, a political
subdivision of the State of Georgia, hereinafter referred to as the Grantee;
WITNESSETH
That the Grantor, for and in consideration of TEN DOLLARS ($10.00) in hand
and truly paid by the Grantee at and before the sealing and delivery of these presents,
and other valuable consideration, the receipt whereof is hereby acknowledged, does
hereby grant, bargain, sell, convey and confirm unto the Grantee the following described
real property,TO WIT:
All that certain tract or parcel of land, situate, lying and being in Augusta, Georgia,
containing 2.07 acres, more or less, and lying on the North side of Dennis Road.
Beginning at a point on the North side of the 60' right-of-way known as Dennis Road
and traveling N 40040'13" W for a distance of 280.38 feet to a point; then turning N
18006'56" W for a distance of 200.00 feet to a point; then turning N 71053'04" E for a
distance of 230.00 feet to a point; then turning S 18006'56" E for a distance of
348.65 feet to a point; then turning S 36031'26" E for a distance of 70.00 feet to a
point; then turning and running down the North side of Dennis Road right-of-way S
55000'11" W for a distance of 151.07 feet back to the Point of Beginning. Said
property is bounded on the North and East by property of the HomeSites, Ltd., on
the West by property now or formerly of O'Shields and on the South by Dennis
Road, as shown on a plat prepared for Augusta, Georgia, by Robert L. Herrington,
Jr., dated December 10, 2002, attached hereto as EXHIBIT "A", to which plat
reference is made for a more complete and accurate description of said property, its
exact location, dimensions, metes and bounds.

Also, an easement in perpetuity over, under, across and through all that tract or
parcel of land, situate, lying and being in Augusta, Georgia, consisting of 0.43 acre
(18,831 Square Feet) and lying on the South side of Dennis Road. Beginning at a
point on the South side of the 60' right-of-way known as Dennis Road and traveling
S 50055'51" E for a distance of 328.23 feet to a point; then S 51027'12" E for a
distance of 96.33 feet to a point; then S 50042'45" E for a distance of 107.45 feet to
a point; then S 50050'40" E for a distance of 223.79 feet; then S 33029'41" E for a
distance of 190.23 feet to a point; then turning and traveling S 62016'05" W for a
distance of 20.11 feet; then turning and traveling N 33029'41" W or a distance of
185.16 feet; then N 50050'40" W for a distance of 220.76 Feet; then N 50042'45" W
for a distance of 107.35 feet; then N 51027'12" W for a distance of 96.29 feet; then N
50055'51" W for a distance of 327.60 feet; then turning and traveling N 37030" E for a
distance of 20.01 feet back to the Point of Beginning. Reference is hereby made to a
plat prepared for Augusta Richmond County Commission, by H. Lawson Graham &
Associates, Inc., dated February 3, 2003, and attached hereto as EXHIBIT "B", for a
more complete and accurate description of said property, its exact location,
dimensions, metes and bounds.
Also, a temporary construction easement, ten (10) feet in width, consisting of 0.22
acre (9,403 Square Feet), running the entire length of the easement in perpetuity, as
described above. Said temporary easement is shown on the plat prepared for
Augusta Richmond County Board of Commissioners by H. Lawson Graham &
Associates, Inc., dated February 3, 2003, attached hereto as EXHIBIT "B" and to
which reference is made for a more complete and accurate description of said
temporary easement, its exact location, dimensions, metes and bounds. Said
temporary easement shall expire at the completion and final acceptance of the
Project by Augusta.
TO HAVE AND TO HOLD said property, together with all the rights, ways
and appurtenances thereto belonging, or in anywise appertaining, unto the
Grantee, Grantee's successors, assigns, or legal representatives, in fee simple,
forever.
AND GRANTOR SHALL AND WILL WARRANT and forever defend by virtue
of these presents, the right and title to the property unto Grantee against the
claims of any person owning, holding, or claiming by, through or under Grantor
and all and every other person or persons.
IN WITNESS WHEREOF, the Grantor has signed and sealed this deed the
day and year first above written.
