Dear Linda: Please.place on the agenda of the next Public Safety Committee meeting to approve mutual release between Richmond County and Nicholas Dickinson & Associates regarding the Joint Law Enforcement Center. I "7 MUTUAL RELEASE COUNTY OF RICHMOND (hereinafter "Dickinson"); WIT N E SSE T H: WHEREAS ,on February 11, 1992, the parties hereto entered into a standard form of agreement between Owner and Architect for the expansion and renovation of the County's Joint Law Enforcement Center located on Walton Way in Augusta,' Georgia; and WHEREAS, on or abou t February 22 , 1995 , t he County terminated Dickinson's contract to provide architectural services on said project; and WHEREAS, Dickinson has asserted certain claims against the County for additional fees and expenses allegedly owed Dickinson under said contract through the date of termination; and WHEREAS, the County has asserted certain claims arising out of Dickinson's performance of its contract in connection with the Joint Law Enforcement Center, including but not limited to, a refund of alleged overpayments made to Dickinson under its contract; and , '. -; ... ,. 7' ,. WHEREAS, the parties hereto desire to compromise and settle all disputed claims related, to the contract for the provision of ~rchitecturalservices on the Joint Law Enforcement Center, and each desires to release and discharge the other from any future claims that could be asserted with respect to the work performed under said' corttract. NOW, THEREFORE, premises considered and the mutual covenants hereinafter set forth, the benefits flowing to and from each of the parties hereto, follows: and detriments it is agreed as (1) Both parties hereby release and discharge the other from any and all claims, demands, action, or causes of action that have heretofore accrued to either party under the contract between Richmond County and Nicholas Dickinson & Associates, P.C., dated February 11, 1992 and any amendments thereto, specifically including but not limited to, the County's claim for reimbursement of any overpayment it allegedly made to Dickinson, and Dickinson,' s claim for additional fees and expenses allegedly earned in the sum 'of $410,557.00. (2) Dickinson agrees to assist the County in securing the premium refund in the sum of $21,170.00 in connection with the purchase and later cancellation of Dickinson's professional liability insurance for work performed under its contract on the - " ,~ i '" ..... ,. .. ,'.; - Joint Law Enforcement Center Project. (3) The' County releases Dickinson from any and all claims, known and unk~own, which have resulted or which may result in the future out of the architectural services rendered by Dickinson pursuant to the February 11, 1992 contract for the Joint Law Enforcement Center expansion and/or renovation.
