Bo 00 Tuck ,GA 30085-2800 ENCROACHMENT PERMIT Goshen-South Augusta 230KV STATE OF GEORGIA COUNTY OF Richmond Date: 01-29-04 Application No.: 30695 THIS PERMIT is issued by GEORGIA TRANSMISSION CORPORATION (AN ELECTRIC MEMBERSHIP CORPORATION), of the County of DeKalb and State of Georgia, hereinafter referred to as Grantor, in favor of: Augusta Utilities, Augusta, Georgia, a Political Suhdlvision of the State of Georgia whose address is .360 Bay Street, Suite I XO. Augusta, Georgia 3090 I hereinafter referred to as Grantee (the words "Grantor" and "Grantee" to include their respective heirs, successors, assigns, agents and employees where the context requires or permits). Grantor hereby grants permission and consents for Grantee to use the following described property for the following described uses: LOCATION County: Richmond Land Lot N/A I GMD: Land District: 121 Station No. : 333+20 to Station No. : 332+50 Further Description: Windsor Spring Road as shown on the attached drawing, whieh is made a part hereof. USES The use by Grantee of the above-described property is limited to the following purpose(s): installation and maintenance of 8" pve Sanitary Sewer crossing at a 45 degree lingle. Grantee hereby consents and agrees to the following terms and conditions: 1. Grantee is responsible for obtaining whatever rights may be necessary from others who may own or hold interests in the said property. 2. The use of the said property by Grantee shall be at the sole risk and expense of Grantee, and Grantor is specifically relieved of any responsibility for damage to the facilities and property of Grantee resulting or occurring from the use of said property by Grantor as it now is or hereafter may be used. Grantee covenants not to sue Grantor if such damage should occur. 3, Grantee agrees to use the said property in such a manner as will not interfere with Grantor's activities and facilities as now or hereafter exist thereon. If it is determined, in Grantor's judgment, that Grantee's use ofthe property does in fact so interfere, Grantee shall take whatever action is, in Grantor's judgment, necessary to remove such interference. If Grantee refuses or fails to take such action promptly, Grantor may, at its option, remove such interference, and grantee shall be liable for the costs of said removal. 4. Grantee agrees that all portions of land disturbed by the use of said property shall be stabilized at all times against erosion and at the conclusion of any installations Grantee shall restore vegetation cover. 5. Grantee acknowledges Grantor's right and title to the said property and the superiority of Grantor's right to use this property, which right shall not be restricted or modified by this permit or Grantee's use of the said property. , I' . , . .. Grantee hereby agrees and covenants not to use and will prohibit agents, employees and contractors of the Grantee from using any tools, equipment or machinery within ten (10) feet of Grantor's overhead conductors. Grantee agrees to comply with Official Code of Georgia 946-3-30 et seq. (High-Voltage Safety Act), and any and all Rules and Regulations of the State of Georgia promulgated in connection therewith, all as now enacted or hereinafter amended; and further agrees to notify any contractor that may be employed by Grantee to perfonn any of the work referred to in this Agreement of the existence of said code sections and regulations and to require said work to be perfonned in compliance with said code sections and regulations. Grantee further agrees and covenants to warn all persons whom Grantee knows or should reasonably anticipate for any reason may conduct any activity whatsoever in the vicinity of the conductors of the fact that such conductors are ENERGIZED, UNINSULATED, apd DANGEROUS. 7. Grantee agrees to reimburse Grantor for all cost and expense for any damage to Grantor's facilities resulting from the use by Grantee of the said property. 8. Grantee shall and does hereby agree to indemnify and save hannless Grantor from the payment of any sum or sums of money to any person whomsoever, including third persons, Grantee, subcontractors, and the guests, agents and employees of Grantee and Grantor, and will defend (and pay all reasonable attorneys fet:s k' attoffi;':YS approved by Grantor to so defend) all claims, suits. causes of action, judgments or damages growing out of injuries to persons (including death) or damage to property (including property of third persons, Grantee and Grantor) in any way attributable to or arising out of Grantee's use of said property. 9. Grantee shall notify Grantor within three (3) days after completion of any improvements upon the said property allowed by this Agreement. Notice shall be given to Grantor's Senior Transmission Line Specialist at (706) 667-5654. 10. Special Stipulations: See Exhibit "A" This Pennit shall inure to the benefit of and be binding upon the parties, their heirs, successors and assigns. IN.
