EPD-WQ-3717 Amendment NO.1 CONSENT ORDER WHEREAS, Consent Order No. EPD-WQ-3717 (Order) was executed between the Director of the Georgia Environmental Protection Division (Director, EPD) and the City of Augusta (City) on April 18, 2000; and WHEREAS, the Order was issued to address construction of a sewer line to eliminate wet weather overflows from the Raes Creek sewer line; and WHEREAS, the Order included a sewer ban in the Raes Creek Basin; and WHEREAS, construction of a segment of the Raes Creek line was completed in July 2001; and WHEREAS, the City has continued to experience and report to EPD, wet weather overflows from the Raes Creek sewer line; and WHEREAS. the City has co::ti:iued to submit sewer connection approval requests to EPD; and WHEREAS, during an August 28, 2002 meeting between the City and EPD, the City discussed plans for the replacement of a section of the Raes Creek sewer line from the Augusta Country Club to the Mid City Interceptor, which includes replacement of the current line and 1 A" relief line (Raes Creek Project); and 1 " WHEREAS, the 10" relief line was installed temporarily to address wet weather overflows until such time as a permanent 54" line could be installed; and WHEREAS, the City submitted an April 2002 Engineering Report to EPD for the Raes Creek Project; and WHEREAS, EPD's September 12, 2002 letter to the City concurred with the technology and selected route for the 54" replacement line; and WHEREAS, the City submitted a September 5, 2002 letter to EPD containing a schedule for completing the Raes Creek Project; and WHEREAS, EPD concurs with the construction schedule for completing the Raes Creek Project. NOW, THEREFORE, the Director hereby amends the Order and the City AGREES to the amendment, as follows: 1. Complete construction of the Raes Creek Project by September 1, 2005 in accordance with the scope of work outlined in the City's September 5, 2002 letter to EPD. 2. Submit to EPD within 30 days of the execution date of this amendment, a procedure for the management of the current relief line, including flow monitoring and alarm system, and criteria for activating supplemental pumping. in order to ensure unpermitted discharges will not occur from the Raes Creek sewer line or relief line.
