Resolution
WHEREAS, the Solo Cup Company has been a landmark in Augusta since 1947, when the Lilly-Tulip Company
built the 180,000 square foot manufacturing plant; and
WHEREAS, in 1989 Sweetheart Holding, Inc. purchased the company and expanded to a 345,000 square foot
operation; and
WHEREAS, the plant employs 221 workers and the average worker has over sixteen years of loyal service. The
plant has the lowest turn-over rate in the area of 1.5% with most due to retirement; and
WHEREAS, the Augusta Plant is the most productive, and efficient facility in the 22 plant Sweetheart
organization and produces the company's flagship product, the Trophy-Brand disposable cup, which is used by
the McDonald's Corporation and several other high profile commercial customers; and
WHEREAS, the Augusta community has a ready, willing, and very skillful workforce, with an array of
organizations to offer employee support and training; and
WHEREAS, we are very fortunate and proud to have Solo Cup Company as a part of our corporate community
and lookforward to a long and productive relationship; and
THEREFORE, BE IT RESOL VED, that the Augusta-Richmond County Commission on behalf of its citizenry
extends a hearty welcome to the Solo Cup Company.

BE IT FURTHER RESOL VEl), that this Resolution be spread upon the official Minutes of the Augusta-
Richmond County Commission, and a copy hereof sent to the Solo Cup Company.
Duly adopted by the Augusta-Richmond County Commission this 6th day of April 2004.

THIS INDENTURE made and entered into this ~O ~ay of M~}-c....~ 2004, between
EUGENIA M. ROYAL, Individually and as Co-Trustee of Share Trust NO.2 Under the Last Will
and Testament of Charles C. Royal and RONALD D. ROYAL as Co-Trustee of Share Trust NO.2
Under the Last Will and Testament of Charles C. Royal, hereinafter referred to as OWNERS, and
AUGUSTA, GEORGIA, a political subdivision under the laws of Georgia, hereinafter referred to
as AUGUSTA;
WITNESSETH, that Owners, for and in consideration of the sum of ONE DOLLAR
($1.00) in hand and truly paid by Augusta at and before the sealing and delivery of these
presents, and other valuable consideration, the receipt whereof is hereby acknowledged, have
granted, bargained, sold, conveyed and confirmed, and by these presents do grant, bargain, sell,
convey and confirm unto Augusta, its successors and assigns, an easement in perpetuity under,
across and through the hereinafter described parcel of land, as follows:
Said easement consists of 14,389 Square Feet, more or less, of permanent utility
easement, as shown on a plat prepared by Harbin and Harbin and dated February 2002, revised
June 17, 2003, attached hereto and made a part hereof, to which reference is made for a more
accurate and complete description of the metes, bounds and courses, and being for the purpose
of laying, relaying, installing, extending, operating, repairing and maintaining pipelines
transporting and carrying utility services (the "Project").
Owners do also grant unto Augusta a temporary easement consisting of 15,892 Square
Feet, more or less, as shown on said plat. The temporary easement herein described being
granted with the right to dig such trenches in said parcel of land as may be necessary for the
Project, to pile thereon the material excavated, and to haul pipe, supplies and equipment
connected with the construction and maintenance thereof, over, along and across the said parcel
of land. Said temporary easement shall expire at the completion and final acceptance of the
Project by Augusta.
Owners do also grant, bargain, sell and convey unto Augusta, its successors and
assigns, the right to clear, and keep clear, all trees, undergrowth and other obstructions from said

permanent easement, along with the free right of ingress and egress to and from said permanent
easements for this purpose.
Owners, their heirs, assigns and legal representatives, after the completion of this
Project, shall have the right to use said parcel of land in any manner not inconsistent or interfering
with the rights herein granted, excludinq, however, the right to plant thereon any trees or other
vegetation that may interfere with the laying, relaying, installing, extending, operating, repairing
and maintaining of pipelines transporting and carrying utility services and the right to erect,
construct or maintain thereon any buildings, structures, or other permanent improvements.
TO HAVE AND TO HOLD the aforesaid rights, ways, easements, privileges and
appurtenances unto Augusta, its successors and assigns, in perpetuity.
