Gentlemen:
RE: Cambridge - Section One
We hereby establish our Irrevocable Letter of Credit # 4-2000 in your favor for Nordahl &
Company, Inc. and thereby undertake to honor your drafts at sight on us after June 2, 2000 not
exceeding in the aggregate $75,000.00. Each such draft must be accompanied by the following
documents:
1. A written certificate executed by the appropriate and authorized Richmond County
government staff stating that Nordahl & Company, Inc. has failed to make the required
improvements within the term of the attached Performance Guarantee and that the amount of
said draft represents the actual amounts of funds due,you as a result of his failure to perform as
contracted.
2. All drafts drawn under this credit must be marked "Drawn under SunTrust's Letter of Credit
4-2000, dated June 2, 2000."
This credit is valid until June 2, 2001. Drafts drawn hereunder, if accompanied by documents as
specified above, will be honored if presented to Sun Trust on or before said dated at 801 Broad
Street, Augusta, Georgia 30901.
It is further understood and agreed that when the required improvements have been approved for
conformity by Richmond County Council, this Letter of Credit shall be released and returned. In
addition, when any portion of the required improvements has been completed and approved, the
Letter of Credit may be reduced by an amount commensurate with the cost of these completed
improvements. In no event shall the Letter be reduced below $75,000.00.
Except as otherwise expressly stated herein, this credit is subject to the "Uniform Customs and
Practice for Documentary Credit," ICC Publication 500,1993 Revision.

PERFORMANCE GUARANTEE
KNOW ALL MEN BY THESE PRESENTS that we, Nordahl & Company. Inc. . as principal are held and firmly bound unto
Richmond County, Georgia, as obligee, in the sum of $75.00.00.. For payment whereof to the obligee, the principal binds itself, it
heirs, executors, administrators, successors and assigns, jointly and severally, firn1ly to these presents:
Signed, sealed, and dated, this ~ day of June. 2000.
WHEREAS, application was made to the obligee for approval of a subdivision shown on plat entitled "Cambridge - Section One.
dated April 13. 2000. and filed with the Augusta-Richmond County Planning Commission, and said final plat was approved upon
certain conditions, one of which is that a perforn1ance guarantee in the amount of$75.000.00 be filed with Augusta-Richmond County
Planning Commission to guarantee certain improvements in said subdivision.
NOW, THEREFORE, THE CONDITIONS OF THIS OBLIGATION is such that if the above - named principal shall, within ~
from the date hereof (in no case shall the performance guarantee be valid for less than six months or more than one year), truly make
and perform the required improvements and construction of the public improvements in said subdivision in accordance with
Richmond County specifications, then this obligation will be void, provided that all of the necessary documentation as is required by
the Richmond County Code of Ordinance for the improvements to be accepted into the County system have been completed and
approved by the appropriate Richmond County staff.
It is hereby understood and agreed that in the event any required improvements have not been installed within the term of the
Performance Guarantee or the necessary documentation has not been completed and approved for the improvements to be accepted
into the County system, the Richmond County Planning Commission or the appropriate Richmond County government staff may
thereupon declare this guarantee to be in default and collect the sum remaining payable thereunder, and upon receipt of the proceeds
thereof, Richmond County shall install such improvements as are covered by the guarantee.
It is further understood and agreed that when provision of the Richmond County Code of Ordinances have been complied with and
documents approved by the County Councilor by the appropriate Richmond County government staff, the guarantee shall be released
and returned. In addition, if any portion of the required improvements is completed by the principal and approved by the appropriate
Richmond County government staff, a portion of the guarantee commensurate with the cost of these completed improvements may be
released and returned. In no event shall a performance guarantee be reduced below twenty-five (25%) percent of the principal amount
until all improvements have been approved by the appropriate Richmond u g staff.

The Surety as specified herein shall be a Corporated Surety licensed to do business in the State of Georgia. In lieu thereof, the

alignment and location of said Road.
