Dear Harry:
Attached hereto is a counter offer for right-of-way on Tax Map 98-2, Parcel 26, of the
Bungalow Road Improvement Project. The owners of this property counter offered $3,000.00,
which is $1,667.00 over our appraised offer of$I,333.00. Also, under "Special Provisions," Exhibit
"A" is attached that requests certain things of the City before, during and after this construction.
These provisions were discussed with our Pre-Construction Section, and they would only approve
one of them. Therefore, I am sending you this parcel for condenmation.
You may want to check ownership, since we have not received the title opinion on this
parcel. Please let us know if additional information is required.

Special Provisions
We, the undersigned, hereby offer the counter price based on the following
factors:
1. The portion of land the City of Augusta, Georgia plans to acquire (Tax Map 98-2,
Parcel 26) is not only situated on Bungalow Road, but at the intersection of Bungalow
Road and Peach Orchard Road.
2. Total inaccessibility for business as well as for delivery of merchandise on Bungalow
Road for a period of twelve months during construction.
3. Compensation for the loss of the revenue from the public telephone booth, which was
built on the land that the City acquires.
The City of Augusta, Georgia agrees to be bound to such terms as:
1. The construction work shall be completed within a twelve month time period.
2. The City shall be liable for all damages to persons or properties that is caused by the
construction.
3. Dirt dug up each day is to be removed so that the tenant is not to be denied the use of
the 'property.
4. There shall not be storage of materials or equipment on the premises.
5. After the completion of the job, the City is responsible for the restoration of the
parking area with like pavement and lines in the lot marking parking spaces.
6. The City is further responsible for the restoration of any damages done to the drains
of the parking lot.

If the said Augusta, Georgia, shall within 60 days after date hereof, pay me the sum of $1 :333.08;

attached hereto and made a pmi hereof by reference, to be used for highway purposes on the
BUNGALOW ROAD IMPROVEMENT PROJECT, being Tax Map 98-2, Parcel(s) 26, consisting of
249.20 sq, ft. in fee, more or less, and N/ A sq. it. of permanent drainage and utility easement, more or
less, and 2,103.39 sq. ft. of temporary construction easement, more or less, on project BUNGALOW
ROAD IMPROVEMENT.
