OPTION
FOR AND IN CONSIDERATION of the sum of One ($1.00)
Dollar, the receipt whereof is hereby acknowledged, the undersigned
hereby gives, grants and conveys unto Richmond County, Georgia the
sole and exclusive right, privilege and option to purchase on the
terms and conditions hereinafter set forth, the property described
on Exhibit "A" attached hereto, in connection with the Augusta
Commons Project. Th~'S tion must be exercised by Richmond County

and deliver to the Richmond County, Georgia fee simple title and
easements to the real property and all improvements thereon owned
by the undersigned as described more fully on Exhibit "A".
See Note 1, Page 2.
(2) The undersigned hereby covenants and represents that
the title to said described property will remain unchanged during
the period covered by this option and that the undersigned owns the
fee simple unencumbered title to said property, subject to title
exceptions of record.
(3) The undersigned agrees to furnish a marketable title
to said property and agrees to convey said property by general
warranty deed at the 'time the sale is consummated, subject only to:
(a) The covenants, restrictions and zoning
ordinances not violated by the existing
improvements or use of the property specified
in this contract; and
(b) The encumbrances and leases specified in
the attachment "A" of this contract. .
(4) Throughout the period of this option, Richmond
County, Georgia shall have the right and privilege to enter upon
the subject property for the purpose of inspection and conducting
necessary surveys, engineering tests, environmental studies or
appraisal reports.
(5) Should this option be exercised it is agreed and
understood that any tenant now in possession or any other person
having a claim or interest in the subject property will have not
less than two (2) months from the date of execution of a deed to
vacate the premises and that upon vacating the premises, only items
of personal property will be removed, all items attached to the

property and being classified as improvements or ", fixtures to
remain. The undersigned herein further agrees to provide without
costs to Richmond County, Georgia, a quitclaim deed or such other
releases as may be required by the closing attorney from any tenant
now in possession of the subject property and any other persons
having a claim or interest in the subject property.
