BURNLEY, hereinafter referred to as the "Declarant", WITNESSETH THAT: WHEREAS, TONY E. BURNLEY is vested with fee simple title to certain real property located in Richmond County, Georgia, being described as Lots B32 - B52, Phase II, as shown on Plat of Heather's Glenn Subdivision prepared by John A. McGill, dated October 24, 2001, and recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty (?Clbk 2 1 ~ . 1ted: ft" at pages 1/ 7- ;)j9L, to which Plat reference is hereby made for a more complete '\ and accurate description of said property, its metes, bounds and location; WHEREAS, prior Declaration of Covenants, Easements and Restrictions affecting said Heather's Glenn Subdivision has been recorded in the Richmond County Clerk's office in Deed Book 713 at page 712, and it is the desire of Declarant that said Declarations and Covenants, Easements and Restrictions now be applicable to Phase II of said Heather's Glenn Subdivision containing Lots B32 - B52; NOW, THEREFORE, declare, that said Declarations of Covenants, Easements and 1 " .
