As a further inducement to Surety for making payment at this time, undersigned hereby agrees that all guarantees and warranties required under the terms of the aforesaid contract pertaining to the work, labor and materials furnished by the undersigned shall remain in full force and effect in accordance with their terms which, however, shall not be extended nor enlarged hereby. Surety shall remain responsible for the one year warranty of the contractor as set forth in the contract documents and nothing herein shall be construed as relieving Surety from said obligation. The undersigned further warrants and represents and hereby certifies that all just and lawful billings, accounts and/or amounts due from the undersigned and/or its subcontractors or material suppliers tor labor, material, equipment employed in the performance of this contract have been fully paidin accordance with the terms and conditions of said contract(s) and that there are no amountS for which the undersigned would be responsible under the above agreement, all amounts having been fully paid and other terms of the relevant subcontract, material supply contract or purchase order having been fully complied with by the undersigned. Augusta-Richmond County has paid out a total of $126,104.59 to complete the building. . The following is a breakdown of payments to various contractors involved with the construction that was administered through James G. Swift & Associates: CONTRACTOR NAME AMOUNT PAID . . J & G Construction $73,239.56 Maddox Construction $17,072.00 D & M (Paul Dyson) $29,410.00 KATvlA Construction Co. $2,500.00 Universal Steel $83.03 James G. Swift & Associates $3,800.00 TOTAL AMOUNT PAID $126,104.59 1206 Interstate Parkway · Augusta, Georgia 30909 .. Page 2 Mr. Jim Wall Augusta Golf Course Improvements - Maintenance Bldg. July 16, 1999 The original contract with J & G Construction Co. was in the amount of $105,300. The difference between the original contract price and the total amount paid out is $20,804.59. This is the amount for which the bonding company is responsible. I know that there were outstanding claims submitted by other suppliers that J & G.Construction Co. failed to resolve. I assume that these issues have been turned over to the bonding company. If you should have any questions or comments, please do not hesitate to call.
