WHEREAS, at the regular meeting of the Augusta Commission of Augusta Georgia held
on 3rd day of October, 2000 a motion was made and duly seconded that Augusta Commission
agree to the terms of the contract for a state grant between the Georgia Department of Natural
Resources and Augusta Commission for a grant of financial assistance to
West Augusta Little League ,
authorize Bob Young. Mayor to. execute said contract on behalf of Augusta Commission. and
accept the grant provided for in said contract in the amount of $ 24 .000

CoUnty, Georgia that the terms and conditions of the contract between the Geo~gia D~partment of
Natural Resources and the Augusta Commission are hereby agreed to, that the Mayor is
authorized and empowered to execute said contract and any subsequent amendments thereto on
behalf of the Augusta Commission. and the grant provided for in said contract in the amount of
$?4,000 is hereby accepted to be used under the terms and conditions of said contract, and
that sufficient funds have been designated to assUre the acquisition and/or development, operation
and maintenance of the facilities and/or delivery of services as identified in said contract.

Governor's Discretionary Fund
On behalf of Governor Roy Barnes, I am pleased to provide you the appropriate
documents which will enable the'Department of Natural Resources to make a Governor's
Discretionary Fund grant to your community for the lighting of the West Augusta Little
League ball field.
Attached are two copies of the contract containing the specific terms of the grant, a
sample resolution & certification'fornl authorizing acceptance of the grant and certifying that
the resolution has been entered into the official minute book of the applicant.
Please have both copies of the contract signed and notarized, prepare and have signed
a resolution & certification form, and return all documents to the following address:

THIS AGREEMENT, made and entered into the 3rd day of October
in the year of Two Thousand (2000), by and between the DEPARTMENT OF NATURAL
RESOURCES (hereinafter referred to as the "DEP ARTMENT"), whose address is 205

and the AUGUSTA-RICHMOND COUNTY BOARD OF COMMISSIONERS (hereinafter
referred to as the "GR.Al"J"TEE"), whose address is 530 Greene Street, Augusta, Georgia
30911-4406.
WITNESSETH
WHEREAS, the prOVIsIOn of adequate public recreation and park facilities,
equipment, and area; the preservation of scenic, historical, ecological, and scientific sites,
and the safe maintenance of such areas and facilities is an obligation of State government
and a benef!.t to all "the people; and
WHEREAS, Section 12-3-32 of the Official Code of Georgia Annotated (O.C.G.A.)
requires the DEPARTMENT to provide the above-mentioned services and facilities; and
WHEREAS, the DEPARTMENT is authorized by Section 12-3-5 of the a.c.G.A.
to contract with any county, municipaJity, local government or combination thereof or any
public or private corporation or person to further or assist in furthering any of the services,
purposes, duties or responsibilities or functions vested in the DEPARTMENT; and "

WHEREAS, the GRANTEE has a need to increase recreation opportunities for the
citizens of Richmond County and the costs of the Project are higher than may be adequately
borne by the GRANTEE; and
WHEREAS, the Governor has made available to the DEPARTMENT the sum of
TWENTY-FOUR THOUSAl'ID DOLLARS ($24,000) from his discretion~rYfunds toassist.
the GRANTEE with the above project;
NOW, THEREFORE, in consideration of the promises, conditions and covenants
hereinafter set forth, the parties hereby agree as follows:
(1) The GRANTEE agrees by the necessary negotiations, agreements, contracts and
use of its own personnel and facilities to:
(a) utilize the financial grant-in~aid to help offset expenses of lighting the
West Augusta Little League ball field and other related improvements;
(b) develop, operate and maintain the facilities for all of the people of the
State of Georgia;
(c) execute and complete this PROJECT by the 31 th day of December, Two
Thousand Two (2002);
(2) The DEPARTMENT will, in consideration of such undertakings by-the
GRANTEE, pay to the GRANTEE the sum of TWENTY-EOUR THOUSAl"\ID DOLLARS
($24,000) upon the signing of this Agreement by both parties thereto.

(3) The GRAJ.'JTEE and the DEPARTMENT mutually agree: that this Agreement
is based upon the condition that if the GRANTEE fails to perform fully that which it herein
agrees to perform, this contract shall be void and of no effect and in such event, any funds
thus far paid by the DEPARTMENT to the GRANTEE shall be returned, and shall be due
. and owingto said DEPARTMEN!,butifsuch ccmditioriiS fully and truly' performed, this..
Agreement shall be and remain in full force and effect.
. (4) The failure of the D EP AR TMENT at any time to require performance by the
GRANTEE of any provision thereof, shall in no way affect the right ofthe DEPARTMENT
thereafter to enforce the same, nor shall the waiver by the DEPARTMENT of any breach of
any provision thereof be taken or held to be a waiver of any succeeding breach of the
provision or as a waiver, modification or rescission of the contract itself. This agreement
and the proceeds of this agreement may not be assigned nor may the performance thereunder
be assigned except with the prior written consent of the Commissioner of Natural Resources.
(5) The GRANTEE covenants t~at it presently has no interest and shall not acquire
any interest, direct or indirect, which would conflict in any manner or degree with the
performance of services required to be performed under-this Agreement. The GRANTEE
further covenants that in the performance of this Agreement it will not contract with or
employ any such person, firm, corporation or

association having any such interest.
(6) The parties to this Agreement certify that the provisions oflaw contained in the
Act prohibiting full and part-time appointive officials and employees of the State from
engaging in certain transactions affecting the State contained in O.C.G.A. Sections 45-10-20
through:A5-1O:-28 have. riot and will not be violated j~ ~Y. respect in. regard to this
Agreement.
(7) If the GRANTEE is a nonprofit contractor as defined in O.C.G.A. Section 50-20-
2, then the GRANTEE agrees to comply with the provisions ofO.C.G.A. Sections 50-20-1
through 50-20-8, and in particular the requirements ofO.C.G.A. Section 50-20-3, and with
such further instructions as the State of Georgia may subsequently require in the
implementation of said provisions.
(8) The Agreement and all rights, privileges, and responsibilities shall be interpreted
and construed according to the laws of the State of Georgia.
(9) This Agreement is at all times subject to applicable State and Federal laws,
standards, rules and regulations now existing or which may be hereafter enacted or adopted.
(10) This Agreement represents the sole and complete understanding of the terms
of this Agreement between the parties hereto and may be amended, changed, or modified
only by a written document signed by the parties hereto.
(11) This Agreement is executed in two (2) counterparts, each of which is. deemed
an original. of equal dignity with the other and

STATE OF GEORGIA GRANT CERTIFICATION FORM
As required by House Bill 1364 of the 1998 Session of the General Assembly, each grant of state
funds to a local government" from the governor's emergency fund or from a special project
appropriation shall be conditioned upon the receipt by the state auditor of a properly completed
grant certification form. One GraD;t. Certification Form ~hould be prepared for. each grant
awarded to the local government. The Grant Certification Form(s) should be submitted to the'
State Auditor with one c,opy of the annual audit report. Questions concerning the preparation
and submission of this form should be referred to Local Government Audit Section of the Georgia
Department of Audits and Accounts.
Instructions for Completion
1. Complete lines A through K on page 2 of this form. Please note that one form should be used for'
. ea~hgrant from the governor's emergency fund or from a special project appropriation.
2. The . appropriate officials should 'sign and date the section entitled "Certification of Local
Government Officials'."

5. If the local government meets the eligibility criteria for .an agreed upon procedures engagement in
accbrdance With the provisions of the Official Code of Georgia Annotated Section 36-81-7, the local
government is responsible for ensuring that the procedures performed by the independent certified
public accountant are sufficient in scope .to . enable the' CPA to complete the Independent
Accountant's Report. These procedures include examination of grant application and award
documentation to become familiar with the terms and conditions of the grant; verification of receipt
of grant proceeds; and evaluation of the local government's documentation of expenditures. The
purpose of these procedures is to comply with the provisions of House Bill 1364 requiring
certifiCation that the grant funds were used solely for the express purpose or purposes for which the
grant was made. .
6. Whether the local government engages an independent certified public accountant to perform an
audit or perform the agreed upon procedures, for purposes of meeting the requirements of House Bill
1364 the independ~nt CPA should be engaged to examine management's assertion of compliance
with the requirement to use grant funds solely for the express purpose or purposes for which the
grant was made. The independent CPA should conduct the engagement in accordance with the
standards for examination engagements for compliance attestation .contained in the Codification of
. Statements on Standards for Attestation Engage~ents.
7. This form and ~e accompanying Independent Accountant's Report is required to be filed. with the
state auditor in conjunction with the annual audit for each year in which grant funds ai-e expended or
remain unexpended by the local government.
