P. 1.: 250550 County: Richmonn Page 1 of 2 MEMORANDUM OF UNDERSTANDING between the Georgia Department of Transportation (hereinafter the DEPARTMENT) and Augusta-Richmond County Commission-Council(hereinafter the OWNER) Whereas the DEPARTMENT proposes to undertake a project to improve the Wal ton Way and Thirteenth Street Intersection (Oescri pti on) by contract through its competitive bidding procedures; and Whereas the OWNER has the following utility facilities which must be adjusted or relocated as a result of the proposed contract: 24" water main ; and Whereas the OWNER does not have adequate equipment and staff to adjust its facilities or for other reasons considers it advantageous to have this work included in the contract to be let to bid by the DEPARTMENT; now therefore, The following is hereby mutually agreed to and understood by both parties: 1. The preliminary engineering, including preparation of detailed plans and contract estimate for adjustment of the utilities described above will be accomplished by (the DEPARTMENT, the OWNER, or the OWNER'S Consultant) The Owner ( Insert Appropri ate Narre) 2. The plans and estimate for the utility work shall be subject to approval of both the DEPARTMENT and the OWNER prior to advertising for bids. 3. All work, necessary for the adjustment or relocation of the described utilities in accordance with the final plans when approved, shall be included in the highway contract and let to bid by the DEPARTMENT except as follows: U..1ateri a 1 s or servi ces to be provi ded by the ~) ), ., Page 2 of 2 .. 4. All construction engineering and contract supervision shall be the responsibility of the DEPARTMENT. The DEPARTMENT shall be responsible to assure that all utility work is accomplished in accordance with the plans and specifications and to consult with the OWNER before authorizing any changes or deviations which affect the OWNER's facil i ti es. 5. The OWNER shall have the right to visit and to inspect the work at any time and to advise the DEPARTMENT'S Engineer-in-Charge of any observed discrepancies or potential problems. The DEPARTMENT agrees to notify the OWNER when all utility work is completed and ready for final inspection by the OWNER. 6. Upon completion of the work and upon certification by the DEPARTMENT'S engineers that the work has been completed in accordance with the plans and specifications, the OWNER will accept the adjusted and additional facilities and will thereafter operate and maintain said facilities without further cost to the DEPARTMENT or its contractor. 7. A determination as to any payment due, to either the OWNER or the DEPARTMENT from the other, as a result of work described in this Memorandum, will be made by the DEPARTMENT in accordance with its current policies and procedures. If compensation is due either party, a separate Force Account Agreement will be prepared by the DEPARTMENT and executed by both parties before payment is to become due.
