SUBJECT: Calvary Deliverance Evangelistic Church Contract

Attached you will find the original contract between Augusta and Calvary Deliverance
Evangelistic Church. I am requesting proper signatures in order to complete the
document. Please forward a copy of the contract with signatures to the Law Department.

AGREEMENT
THIS AGREEMENT made as of the 4th day of September. 2001 by and
between: Calvary Deliverance Evangelistic Church, with its place of business at 844 Scott
Nixon Memorial Drive, Augusta, Georgia; (hereinafter referred to as "the Church") and
Augusta, Georgia, a political subdivision of the State of Georgia, with its place of business at
530 Greene Street, Augusta, Georgia, U.S.A., 30911 (hereinafter referred to as "Augusta ").
* WHEREAS, the Church and Augusta is desirous of pro-rated, cost sharing
Agreement relating to a fire hydrant/water line project along Scott Nixon Memorial Drive,
Augusta, Georgia to serve the Calvary Deliyerance Evangelistic Church hereafter referred to
as "the Agreement".
Now, therefore, inconsideration of the covenants, conditions, and agreements
herein contained, the parties agree .as follows:
The Church hereby agrees to'pay to Augusta the sum of Five thousand dollars
($5,000.00) in the following manner:
The Church shall make an initial payment to Augusta in the amount of One
thousand dollars ($1,000.00) representing-twenty percent (20%) of the total amount by
September 20,2002. Thereafter, the C~u.rch shall pay the remaining balance'ofFour

thousand dollars ($4,000.00) in equal installments over a sixty- (60) month period.
The Churchwill make payments in the amount of Sixty-six dollars and sixty-

'six cents ($66.66) every month for 59 monihs and one final payment the month thereafter in
the amount of Sixty-seven' dollars and six cents ($67.06) until said amount is paid in full. !he
payment shall be due on the 10th day of each month. The Church will begin making said

payments on October 10, 2002 at Augusta Utilities, 360 Bay Street, Suite 180, Augusta,
Georgia 3090 L
Augusta will provide fire hydrant/water line along Scott Nixon Memorial
Drive to serve the Church.
The Agreement is freely entered into without coercion from either party and
with the mutual consent of all parties.
This Agreement shall be governed by and construed in accordance with the
laws of the State of Georgia. All claims, disputes and other matters in question between the
Church and Augusta arising out of, or relating to this Agreement, or the breach thereof, shall
be decided in the Superior Court of Richmond County, Georgia. The Calvary Deliverance
Evangelistic Church, by executing this Agreement, specifically consents to venue and
jurisdiction in Richmond County, Georgia and waives any right to contest jurisdiction and
venue in said Court.
All notices hereunder shall be in writing and shall be duly given if delivered
personally or sent by registered or certified mail, return receipt requested, postage prepaid, to
the respective addresses of the parties appearing on page one of this Agreement. Any notice
given shall be deemed to have been received on the date, which it is delivered if delivered
personally, or ifmailed, on the fifth (5th)'business day next following the mailing thereof.
Either party may change its address for notices by giving notice of such change.

This Agreement represents the complete and exclusive agreement between the
parties with respect to the subject matter hereof and supersedes all prior agreements,
negotiations, discussions, or understanding between them with any way relating thereto.
IN WITNESS WHEREOF, this Agreement has been read, understood, and
signed by duly authorized officials of Calvary Deliverance Evangelistic Church and Augusta,
Georgia.
