AN ACT
To amend an Act creating the Augusta Canal Authority. approved March 30, 1989 (Ga. L.
1989, p. 4750), as amended by an Act approved April 9. 1999 (Ga. L. 1999, p. 3890), so as
to amend the definition of the term "project" and to clarif)' the purpose of the authority
relative to acquiring. constructing, developing. owning, leasing. selling. and operating
buildings and related facilities, including without limitation hydroelectric generating
facilities: to provide an effective date; to repeal conflicting laws: and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION J. '
An Act creating the Augusta Canal Authority. approved March 30, 1989 (Ga. L. 1989. p.
4750). as'amended by an Act approved April 9. 1999 (Ga. L. 1999. p. 3890). is amended by
striking paragraph (5) of Section :2 and inserting in its place the following:
'(5) 'Project' means any undertaking of the authority in connection with the revitalization
and development of Augusta, Georgia, within a project area. and shall be declared to
include the creation of parks and recreation areas; buildings to be constructed and used
for the housing of exhibits, exhibition purposes, amusement or educational purposes, or
any combi,nation of the above: public parking areas and public parking buildings;
causeways, tunnels, viaducts, bridges, and other crossings; thoroughfares, parkways, and
any avenue of traffic: buildings and related facilities. including without limitation
h)'droelectric generating facilities and equipment using water from the Augusta Canal.
used or to be used in economic development or the creation or preservation of jobs, or
both. including;withoutlimitation the location of new buildings and facilities. or the
preservation of existing buildings and f?cilities in the proje~t area; and all other buildings.
structures. or facilities useful and desirabie in connection therewith, extension and
improvements of such facilities, and the acquisition of the necessary property therefor.
both real and personal, in order to accomplish the essential public purpose for which the
authority is created:
SECTION 2.
Said Act is further amended by striking subsection (a) of Section 3 and inserting in its place
.he following:
'(a) It is determined, declared, and established that the purpose of the authority is to
promote the revitalization and development of Augusta, Georgia. through the creation in
the project areas of parks, recreation areas, and through the acquisition, construction.

development, owning, leasing, sale, or operation of new or existing buildings and related
facilities, including without limitation hydroelectric generating facilities and equipment
using water from the Augusta Canal, and all other facilities useful or desirable in
connection therewith. The creation of such areas is intended to develop and promote for
the public good and general welfare trade, tourism, commerce, industry, and employment
opportunities and to promote the general welfare of this state by creating a climate
favorable to the location of new industry, trade, and commerce and the development of
existing industry, trade, commerce, and tourism opportunities within Augusta, Georgia:
SECTION 3.
This Act shall become effective upon its approval by the Governor or upon its becoming law
without such approval.
SECTION 4.
All laws and parts of laws in conflict with this Act are repealed.

Personally appeared before me. the undersigned authority, duly authorized to administer oaths, Jack
Connell. who on oath deposes and says that he is the Representative from the I 15th District and
further deposes and says as follows:
(I) That the anached Notice of Intention to Introduce Local Legislation was published in the Augusta
Chronicle which is the official organ of Richmond County on the follo....ing date: August 17th. .
2001.
(2) That the laws requiring notice of local legislation were further complied with in the :nanner
checked below:
_ A copy of the notice of intention was mailed, transmined by facsimile. or otheTVoise
provided to the governing authority of any county. municipality. or consolidated government
whose charter or enabling Act is amended. as requirec by subsection (b) of Code Sectior.
28-1-14.
_ The notice requirement of subsection (b) of Code Section 28-1-14 does not apply
because the bill was requested by resolution or other wrinen notification of the governing
authority of the affected county. municipality. or consolidated government and a copy of such
resolution or notification is anached hereto.
V The notice requirement of subsection (b) of Code Section 28-1-14 does not apply
because the bill does not amend the charter of a municipality or the enabling Act of a county
or consolidated government or the bill affects a local school. syste'm.
_ The notice requirement of subsection (b) of Code Section :!8-1-14 does not apply
because the bill is an annexation bili and a copy of the bill was provided to the county
governing authority within which the area to be annexed is located at the time th.e notice was
published, as required by Code Section 28-1-14.1.
