HomeMy WebLinkAboutDOUGHTY PARK MEMORANDUM UNDERSTANDING i (C(Q)~lf MEMORANDUM OF UNDERSTANDING Doughty Park 1200 Nellieville Road Augusta, Georgia Year 2006 Community Development Block Grant (CDBG) Program August 1, 2006 - July 31, 2007 This Memorandum of Understanding is for the purpose of establishing the responsibilities and requirements to be assumed by the Augusta-Richmond County Recreation Department and the Augusta Housing and Community Development Department to acquire property located at 1901 Second Avenue for "Doughty Park" to be used for parking for park users as approved by the Augusta-Richmond County Commission as part of its Year 2005-2009 Consolidated Action Plan. PROJECT DESCRIPTION The Project will be identified as "Doughty Park". The purpose of the project is to acquire property located at 1901 Second Avenue to be used as parking for park users, The facility is located at 1200 Nellieville Road, Augusta, Georgia, Census Tract 104, Block Group 7, comprising 93.5% low and moderate income persons. USE OF PROPERTY The center is used for neighborhood activities such as: . Free time for children activities . Adult exercise program . Building can be rented for special events GRANT FUNDS Funding for this Project has been approved by the Augusta-Richmond County Commission and the U.S. Department of Housing and Urban Development in the amount of $30,000. Total cost of this project is estimated to be $30,000. Any costs exceeding the grant amount will be the responsibility of the Augusta-Richmond County Recreation. Department. CDBG funds will specifically be used for acquisition of property. 1 I- PROJECT ACTNITIES The Augusta-Richmond County Recreation Department and the Augusta Housing and Community Development Department agree to jointly administer the "Project" as follows: The Augusta-Richmond County Recreation Department will: 1. Comply with the Community Development Block Grant regulations as set forth at 24 CFR Part 570. 2. Comply with the procurement policies of Augusta-Richmond County and the U.S. Department of Housing and Urban Development procurements procedures specified at 24 CFR 85.36 of the "Administrative Requirements for Grants and Cooperative Agreements to State, Local and Federally Recognized Indian Tribal Governments. " 3. Adhere to the reversion of assets provision of the CDBG regulations at 24 CFR 570.503 (b) (8) whereas "any real property that was acquired or improved in whole or in part with CDBG funds in excess of $25,000 shall be used for its original approved purpose for five (5) years after expiration of agreement." 4. Adhere to provisions of24 CFR 570.207 (a) (3): Political activities. CDBG funds shall not be used to finance the use of facilities or equipment for political purposes or to engage in other partisan political activities, such as candidate forums, voter transportation or voter registration. On an incidental basis, political meetings, candidate forums or voter registration campaigns may be held provided that all parties and organizations have access to the facility on an equal basis, and are assessed equal rent or use charges, if any. 5. Adhere to provisions of 24 CFR 570.200 (b) (2): Fees for use of facilities. Reasonable fees may be charged for the use of the facility, but charges such as excessive membership fees, which will have the effect of precluding low and moderate income persons from using the facility, are not permitted. 6. Adhere to equal opportunity in the provision of services. No persons may be excluded from participation in, denied the benefits of, or subjected to discrimination under any program or activity receiving Federal financial assistance on the basis of race, color, religion, gender, sexual orientation, national origin, age or disability. 7.
