MEMORANDUM OF AGREEMENT BETWEEN RICHMOND COUNTY MARSHAL'S DEPARTMENT AND THE AUGUSTA AVIATION COMMISSION, AN ENTITY OF AUGUSTA, GEORGIA, A POLITICAL SUBDMSION OF THE STATE OF GEORGIA ~;:,_ of Agreomort (MOA) ;, """" "'" """"'" imo th;, Lday o ,2004 by and between the Augusta Aviation Commission, an entity of Augusta, Geor' responsible for the operation of the Augusta Regional Airport, hereinafter referred to as the "Airport", and Richmond County Marshal's Department, hereinafter referred to as the Marshal's Department", approved by M. Steve Smith in his capacity as the duly elected Marshal of Richmond County, Georgia, hereinafter referred to as "Marshal", and the Augusta Richmond County Commission, the governing authority of Augusta, Georgia NOW, THEREFORE, it is mutually agreed that: This agreement will be binding on the parties. hereto for the period commencmg-tlie-7~y-OfMay,2UU4-iit 12:0Ta:m:iiDaen.aiiJ.g at miOiiight December 31,2004. This agreement will then continue on an annual basis beginning January 1st of each year and ending on December 31st of each year unless this Agreement is terminated under Paragraph I of this MOA. 1. Augusta, Airport or Marshal hereto may cancel and/or terminRte this agreement on sixty (60) days notice in writing. Further in the event for any reason there is a change in the person holding the office of Marshal, such newly elected or appointed person shall have the right to terminate the MOA thirty (30) day after taking office. 2. Airport will retain Ooerational Man8ll:ement Control of Marshal's activities while working at Airport to fully support day to day operations. Ooerational Man8ll:ement Control shall mean that degree of control mandated by Airport Rules, Regulations, Polices, FAA, TSA or any other Federal Agency with . jurisdiction over Airport required to maintain the Safety, Security and Operation of Airport. The Marshal shall continue to retain control over all Law Enforcement matters including but not limited to the issuance of citations, arrests, and various local, State, and Federal reports. 3. Airport will incur the initial cost of providing any equipment, supplies or other items needed (i.e. uniforms, vests, weapons, vehicles and training, etc.) for the transition and start up of the Airport Marshals Detachment. 4. Commencing not later than 12:01 am. on May 7, 2004, Marshal shall furnish to Airport law enforcement services by finnishing adequate sworn law enforcement personnel to enforce all Local County Ordinances, State Laws, TSA and FAA Regulations to ensure Airport is secure and compliant with said ordinances, laws and regulations. 5. The Marshal will furnish additional Law Enforcement Officers and resources as needed from time to time for emergencies and other special events as determined by Airport. 6. Marshal will have a minimum manning of two (2) Law Enforcement Officers (LEO's) on duty at all times, with preferably at least three (3) LEO's on duty m_ --rrom8:00a.m. to -6:00 - p.m.- or someUotner time penod based upon flight schedules. Marshal will ensure that additional Law Enforcement Officers have been trained by Airport for Ramp Driving, Sterile Area and Security Identification Display Area (SIDA) baclgine requirements. This will be done to help in situations of sick time and vacation coverage. 7. Airport and Marshal jointly agree to interview and select new Chief in the future if needed to manage the Marshal's Detachment at Airport. 8. Airport and Marshal agree that Airport will conduct annual performance evaluation (PE) for Chief measuring Ooerational Mana"""'ent Control as indicated by paragraph 2 of this MOA. Airport will submit this PE to Marshal to be part of overall evaluation. 9. Airport agrees that Marshal will directly manage and be in possession of all Airport personnel SIDA applications, and related security, law enforcement files . and folders. Additionally, Airport agrees that Marshal will process all SIDA badges. 10. A separate Law Enforcement budget will be established within Augusta Regional Airport's budget. The budget will be compiled of detailed personnel (salary & fringe benefits of each position), operational and capital expenses. Augusta Regional Airport has approval authority for expenses and Marshal will be responsible for management within budgetary constraints. 11. Marshal and Airport will work together each year to come to an agreement on an operating and capital budget to be submitted to the Augusta Aviation Commission and the Augusta Richmond County Commission. 12. All vehicles, office furniture, uniforms, uniform equipment, weapons, resources, and other equipment or furnishings purchased by Airport to support Marshal's Detachment at Airport shall be retained by Airport in the event either party terminat"'8 this agreement.
