Said permanent easement is shown on a plat consisting of Sheets 1 and 2, prepared for Augusta- Richmond County Commission by Southem Land Surveyors, Inc., dated April 13, 2006, and attached hereto as "EXHIBIT A", reference to which is made for a more complete and accurate description of said property, its exact location, dimensions, metes and bounds. Said easement being for the purpose of laying, relaying, replacing, installing, extending, operating, repairing and maintaining pipelines transporting and carrying the utility services of Augusta, Georgia. Also, a temporary construction easement, varying in width, consisting of 0.584 acre (25,448 Square Feet), more or less, as shown on "Exhibit A". Said temporary construction easement shall expire at the completion and final acceptance of this Project by Augusta, but in any not later than July 15, 2008. Grantor does also grant, bargain, sell and convey unto Augusta, its successors and assigns, the right, but not the duty, to clear, and keep clear, all trees, undergrowth and other obstructions from said permanent easement, along with the free right of ingress and egress to and from said permanent easement for this purpose and all other purposes stated in this document. Grantor does agree that no other utilities may be constructed within the aforesaid easement in perpetuity except by written permission of the Augusta Utilities Department. Notwithstanding the foregoing, in the event the construction, installation or maintenance of the sanitary sewer pipeline results in a change in the surface level of the easement area such that drainage across Grantor's property is affected, Grantor shall have the right to install drainage pipe(s) beneath or above the sanitary sewer pipeline, through the easement area for the purpose of restoring drainage of the property to that which existed prior to construction, installation or maintenance of the sanitary sewer pipeline; provided, however that Grantor does agree that it will take every reasonable precaution necessary to ensure that the sanitary sewer pipeline is not disturbed by the installation of such drainage pipe(s). Grantee does agree that Grantor may excavate clay up to, but not within, five (5) feet of the centerline of the sanitary sewer pipe. Grantor does agree that it will take every reasonable precaution necessary to ensure that the walls of said excavation do not collapse and expose the pipeline, or pull it into the mine area. Grantee acknowledges that once the Grantor's property is permitted as a mine site, Grantee must contact Grantor prior to entering the property to facilitate Grantor's compliance with the provisions of applicable governmental mining laws, rules and regulations, including, without limitation, the Mining Safety and Health Administration, Title 30, Code of Federal Regulations, which compliance may include, without limitation, accompaniment of Grantee by a certified miner while on the property.
