TEMPORARY CONSTRUCTION EASEMENT
bU THIS EASEMENT AGREEMENT made and entered into this JJ:!!! day of
(Y--!..t-,.....~oyember. 2006, between R. Bates McCutcheon, III, Patrick R Perry, H. Winston
Bedingfield, Jr. and Hugh M. McCutcheon, hereinafter referred to as Parties of the First
Part, and Augusta, Georgia, a political subdivision under the laws of Georgia, hereinafter
referred to as Party of the Second Part;
WITNESSETH, that the Parties of the First Part, for and in consideration of the
sum of ONE DOLLAR ($1. 00) in hand and truly paid by Party of the Second Part at and
before the sealing and delivery of these presents, and other valuable consideration, the
receipt whereof is hereby acknowledged, has granted, bargained, sold, conveyed and
c'onfirmed, and by thes~" presents does; grant, bargain;, sell, convey and confirm unto the
Party o.f ,th~ ;SecOpd Part, its ,success9rsapd assigns, a temporary construction easement
under, across and through the hereinafter described parcel of land, to wit:
All that lot, tract or parcel of land, situate, lying and being the State of
Georgia. County, of Richmond, said easement being twenty feet in width,
and located on the rear or south boundary line of the property described on
Exhibit A, said easement being further described as beginning at the south
west corner of the property described on Exhibit A and running between
parallel lines twenty feet apart south 67 degrees, 30 minutes 45 seconds
east a distance of 55.12 feet.
This Temporary Construction Easement is granted for the purpose of
allowing Grantee to access, demolish and otherwise remove the
improvements, and debris therefrom, located on Grantee's adjoining
property.
This Temporary Construction Easement shall expire and terminate upon
completion of the demolition and removal of the improvements located on
Grantee's adjoining property.
. ,;{O HAVE AND TO HOLD the'aforesaid rights; ways, easements, privileges and
appurtenances unto the Party of the Second Part, its successors and assigns. Parties of the

First Part do hereby bind themselves, their successors, assigns and legal representatives to
this agreement.

Exhibit A
All that tract or parcel of land together with improvements thereon, situate, lying and
being in the State of Georgia and County of Richmond and City of Augusta, on the south
side of Greene Street between 8th Street and 9th Street, said property fronting for a
distance of 55 feet on Greene Street and extending back between parallel lines for a
distance of 115 feet on its eastern and western boundaries to a rear width of 55 feet. Said
property is bounded as follows: On the North by Greene Street; on the East by lands now
or formerly of Dr. W. H. Doughty, Jr.; on the South by lands now or formerly of
Hollingsworth Candy Company; and on the West by property ofE. C. Fleming, Trustee.
Said property is known as 828 Greene Street under the present system of house
numbering ir.:effect in the City of Augusk, Georgia.
