TIllS INDENTIJRE made and entered into this 1!- day of ~~ 2004, between BCRE
INVESTMENTS, LLC., a Georgia limited liability company, hereinafter referred to as OWNER, and
AUGUSTA, GEORGIA, a political subdivision under the laws of Georgia, hereinafter referred to as
AUGUSTA;
WIlNESSETIl, that Own~r, for and.in consideration of the sum of ONE DOLLAR ($1.00) in
hand and truly paid by Augusta at and before the. sealing anddeljvery of these presents, and other valuable
consideration, the receipt whereof.is heJ;eby.adrnowledged, has. iranted, bargained, so.ld, conveyed and
confirmed, and by thes~ presents does irant, bargain, sell, convey and confirm unto Augusta, its,successors
and assigns, a non-exclusiv~ easement in perpetuity under, across and through the hereinafter described
parcel of land.
Said easement consists of 4,517 Square Feet, more or less, as shown on a plat prepared by
Cranston, Robertson & Whitehurst, P .C., dated October 17, 2003, revised December 15, 2003, hereinafter
referred to as the "Plat", attached hereto 'and ma~e... <l :part' h.l:;r~p,f,.., to which reference is made for a more
accurate and complete description of the metes, 1:lo~nds, a1l4 .~o~lfSes, and being for the purpose of laying,
relaying, installing, extending, operating, repairing and maintaining pipelines transporting and carrying
utility services, the same hereinafter being referred to as the "Project."

Owner does also grant unto Augusta a temporary easement consisting of 1,516 Square Feet, more
or less, as shown on said }>lat. Said easement is granted toge~her with the right to dig such trenches in s!lid
parcel of land as may be necessary for the Project, to pile thereon the material excavated, and to haul pipe,
supplies and equipment connected with the construction and maintenance thereof, over, along and across
the said parcel of land; provided at the expiration of the temporary easement this area will be restored by
Augusta to its prior condition. Said temporary easement shall expire at the completion and final acceptance
of the Project by Augusta.
The foregoing permanent and temporary easements' are conveyed by Owner, contingent upon and
subject to the special stipulation that those features lying within the said easement areas and identified on
the Plat as "MONITORING WELL" and "INJECTION WELL" shall not be destroyed, disturbed, or
adversely affected by the Project.
Owner does also grant, bargain, sell and co~vey unto Augusta, its successors and assigns, the right
to clear, and keep clear, all trees, undergr<:>wth and qther obstructions from said permanent easement, along
with the free right of ingress and egress to and from said permanent easement for this purpose; provided
such ingress/egress shall not unreasonably interfere with 'the, Owner's use of its property and if such
ingress/egress access be outside of the easement areas, such access shall be in areas designed by the Owner
from time to time.
Owner, its successors, assigns and legal representatives, after the completion of this Project, shall
have the right to use said parcel of land in any manner not inconsistent or interfering with the rights herein
granted, excluding, however, the right to plant thereon any trees or other vegetation within the permanent
eas~inent area that may interfere with the laying, relaying, installing, extending, operating, repairing and
maintaining of pipelines transporting and carrying utility services and the right to erect, constructor

TO HA VE AND TO HOLD the aforesaid rights, ways, easements, privileges and appurtenances
unto Augusta, its successors and assigns, in perpetuity.
This easement is made by the Owner A~-IS .and WHERE-IS without any representation or
warranty of title or otherwise.
Owner provides the following information relating to the tract of land of which the foregoing
easements will occupy a portion: This property has been.listed on the state's hazardous site inventory and
has been designated as needing corrective action"due .t01 the, presence of hazardous wastes, hazardous
constituents, or hazardous substances regulated under statelaw. Contact the property owner or the Georgia
Environmental Protection Division for further information concerning this property. This notice is
provided in compliance with the Georgia Hazardous Site Response Act. Corrective action is at the time of
this conveyance proceeding under a plan approved by the Georgia Environmental Protection Division.

RESOLUTION
ACCEPTING DEED OF DEDICATION
WHEREAS, the Augusta-Richmond County Commission has been petitioned to
consider accepting a Deed of Dedication of certain property set aside as a utility easement
in perpetuity across the property as shown on the attached plat;
WHEREAS, the Augusta-Richmond County Commission has elected to accept
the property;
WHEREAS, it is appropriate for assent to the dedication by the Augusta-
Richmond County Commission be shown on the face of the Deed of Dedication.
NOW, THEREFORE, it is hereby resolved as follows:
1. The Augusta-Richmond County Commission does hereby accept the
property set aside as shown on the attached plat and described on the
attached Deed of Dedication.
2. It is further determined that the Mayor of Augusta, Georgia shall execute
an acceptance of the property on the face of the Deed of Dedication.
This resolution shall be recorded in the Minutes of the Augusta-Richmond County
Commission, accompanied by the exhibits referred to herein.
