AUGUSTA, GEORGIA EASEMENT DEED )JECT: 80500 -Spirit Creek Force Main & Gravity Sewer ~CEL IDENTIFICATION NUMBER: 216-0-003-00-0 ADDRESS: Mike Padgett Highway THIS INDENTURE made and entered into this 1.[ day of .j VI..- Y 2005, between Arthur ris Busbia, hereinafter referred to as OWNER, and Augusta, Georgia, a political subdivision under aws of Georgia, hereinafter referred to as AUGUSTA; WITNESSETH, that Owner, for and in consideration of the sum of ONE DOLLAR ($1.00) in hand truly paid by Augusta at and before the sealing and delivery of these presents, and other valuable ;ideration, the receipt whereof is hereby acknowledged, has granted, bargained, sold, conveyed and irmed, and by these presents does grant, bargain, sell, convey and confirm unto Augusta, its :essors and assigns, an easement in perpetuity under, across and through the hereinafter described :el of land. Said easement consists of 2,620 Square Feet, more or less, as shown on a plat prepared by lston, Robertson & Whitehurst, P.C., dated December 22,2004, attached hereto and made a part lof, to which reference is made for a more accurate and complete description of the metes, bounds coUrses, and being for the purpose of laying, relaying, replacing, installing, extending, operating, liring and maintaining pipelines transporting and carrying utility services, and all other purposes that be necessary for this project as well as future projects. Owner does also grant unto Augusta a temporary easement consisting of 1,653 Square Feet, e or less, as shown on said plat. Said easement is granted together with the right to dig such trenches lid parcel of land as may be necessary for the Project, to pile thereon the material excavated, and to pipe, supplies and equipment connected with the construction and maintenance thereof, over, along across the said parcel of land. Said temporary easement shall expire at the completion and final ~ptance of the Project by Augusta. Owner does also grant, bargain, sell and convey unto Augusta, its successors and assigns, the :, but not the duty to clear, and keep clear, all trees, undergrowth and other obstructions from said nanent easement, along with the free right of ingress and egress to and from said permanent ~ment for this purpose and all other purposes stated in this document. Owner does agree that no other utilities may be constructed within the aforesaid easement in letuity except by written permission of the Augusta Utilities Department. Owner, his successors, heirs, assigns and legal representatives, after the co"mpletion of this ect, shall have the right to use said parcel of land in any manner not inconsistent or interfering with ~ , ..
