THIS INDENTURE made and entered into this t2- day of ~~k 2003, between Nancy M.
Lord, hereinafter referred to as OWNER, and Augusta, Georgia, a political subdivision under the laws of
Georgia, hereinafter referred to as AUGUSTA;
WITNESSETH, that Owner, for and in consideration of the sum of ONE DOLLAR ($1.00) in hand
and truly paid by Augusta at and before the sealing and delivery of these presents, and other valuable
consideration, the receipt whereof is hereby acknowledged, has granted, bargained, sold, conveyed and
confirmed, and by these presents does grant, bargain, sell, convey and confirm unto Augusta, its
successors and assigns, an easement in perpetuity under, across and through the hereinafter described
parcel of land.
Said easement consists of 1,995.19 Square Feet, more or less, as shown on a plat prepared by
Southern Partners, Inc., dated January 29, 2002, revised April 9, 2003, attached hereto, marked Exhibit
"A", and made a part hereof, to which reference is made for a more accurate and complete description of
the metes, bounds and courses, and being for the purpose of laying, relaying, installing, extending,
operating, repairing and maintaining pipelines transporting and carrying utility services.
Owner does also grant unto Augusta a temporary easement consisting of 997.6 Square Feet,
more or less, as shown on said plat. Said easement is granted together with the right to dig such trenches
in said parcel of land as may be necessary for the Project, to pile thereon the material excavated, and to
haul pipe, supplies and equipment connected with the construction and maintenance thereof, over, along
and across the said parcel of land. Said temporary easement shall expire at the completion and final
acceptance of the Project by Augusta.
Owner does also grant, bargain, sell and convey unto Augusta, its successors and assigns, the
right to clear, and keep clear, all trees, undergrowth and other obstructions from said permanent
easement, along with the free right of ingress and egress to and from said permanent easement for this
purpose.
Owner, her heirs, assigns and legal representatives, after the completion of this Project, shall
have the right to use said parcel of land in any manner not inconsistent or interfering with the rights herein
granted, excludinq, however, the right to plant thereon any trees or other vegetation that may interfere
with the laying, relaying, installing, extending, operating, repairing and maintaining of pipelines
transporting and carrying utility services and the right to erect, construct or maintain thereon any
buildings, structures, or other permanent improvements.
TO HAVE AND TO HOLD the aforesaid rights, ways, easements, privileges and appurtenances
unto Augusta, its successors and assigns, in perpetuity.
And Owner, her heirs, assigns and legal representatives shall and will forever warrant and defend
unto Augusta, its successors and assigns, the rights, ways, easements privileges and appurtenances
conveyed herein, against the claim of any person or persons whomsoever.

1, NANCY LORD, do hereby nominate, constitute and appoint CAROLYN
CALLENDER, my true and lawful attorney in fact to act for me and in my name, place and
stead, to do and perform all the following acts and things, to-wit:

To draw any money which I may hereafter have standing in my name in any bank
whatsoever, and to open any safety deposit box of mine and remove any stocks and/or bonds
or other securities belonging to me therefrom, whenever it may be to my benefit for my
attorney in fact to do so.

To endorse any and all checks for deposit and to deposit them in my bank account.
(3)
To borrow money for me and in my name, and to sign notes in my name in such

and collect the income therefrom, and to adjust and settle any claims which I may have
against any person or corporation whosoever, and to execute any and all receipts and releases
in respect thereto.
To sell, exchange or otherwise dispose of any real property and personal property
belonging to me, or to which I may be entitled, at such prices and on such terms, and at such
times as to my attorney in fact, in his uncontrolled discretion, may deem necessary, advisable
or advantageous. My attorney in fact is authorized to make such sales at private sale, and
without advertisement, and to secure any and all deeds, bills of sale, transfers or other forms
of conveyance for the purpose of transferring title to any property so sold, and to enter in
covenants of warranty in respect thereto.

To attend any and all stockholder's meetings of any corporation in which I may now
or hereafter own stock and to vote at such meetings any stock standing in my name, either
by himself or herself, individually, or by a proxy appointed by him or her. This power to
attend stockholder's meetings and to vote stock standing in my name shall be without
limitation.

To make all tax returns due to be made by me, including returns for Federal and State
income and ad valorem taxes, and to pay all taxes of every kind assessed against me or my
property .

To pay all accounts payable which I may own now or which I may hereafter incur,
and all notes or other bills of exchange made or accepted by me, using any funds of mine
in his or her hands for any or all of these purposes.

they exist at the date of this instrument in Section 4 of an Act passed by the Georgia
Legislature to provide for the incorporation by reference of various powers into wills, trusts,
or other instruments (O.CO.A. ~ 53-12-232) which powers are incorporated into and made
a part of this instrument as though set out in their entirety.

I hereby ratify and confirm any and all acts which my said attorney in fact shall or
may do in or about my business, pursuant to this Power of Attorney, and it is my intention
that he or she shall be authorized and empowered to act in and about my business affairs
during the life of this Power of Attorney, in as full and ample a manner as I could act if I
were there, present and acting for myself.

Road
THIS INDENTURE made and entered into this 2J!J day of ~Je(.. 2003, between James R.
Moore, hereinafter referred to as OWNER, and Augusta, Georgia, a political subdivision under the laws
of Georgia, hereinafter referred to as AUGUSTA;
WITNESSETH, that Owner, for and in consideration of the sum of ONE DOLLAR ($1.00) in hand
and truly paid by Augusta at and before the sealing and delivery of these presents, and other valuable
consideration, the receipt whereof is hereby acknowledged, has granted, bargained, sold, conveyed and
confirmed, and by these presents does grant, bargain, sell, convey and confirm unto Augusta, its
successors and assigns, an easement in perpetuity under, across and through the hereinafter described
parcel of land.
Said easement consists of 1,271.40 Square Feet, more or less, as shown on a plat prepared by
Southern Partners, Inc., dated January 21, 2003, revised October 13, 2002, attached hereto and made a
part hereof, to which reference is made for a more accurate and complete description of the metes,
bounds and courses, and being for the purpose of laying, relaying, installing, extending, operating,
repairing and maintaining pipelines transporting and carrying utility services.
Owner does also grant, bargain, sell and convey unto Augusta, its successors and assigns, the
right to clear, and keep clear, all trees, undergrowth and other obstructions from said permanent
easement, along with the free right of ingress and egress to and from said permanent easement for this
purpose.
Owner, his heirs, assigns and legal representatives, after the completion of this Project, shall
have the right to use said parcel of land in any manner not inconsistent or interfering with the rights herein
granted, excludinQ, however, the right to plant thereon any trees or other vegetation that may interfere
with the laying, relaying, installing, extending, operating, repairing and maintaining of pipelines
transporting and carrying utility services and the right to erect, construct or maintain thereon any
buildings, structures, or other permanent improvements.
TO HAVE AND TO HOLD the aforesaid rights, ways, easements, privileges and appurtenances
unto Augusta, its successors and assigns, in perpetuity.
And Owner, his heirs, assigns and legal representatives shall and will forever warrant and defend
unto Augusta, its successors and assigns, the rights, ways, easements privileges and appurtenances
conveyed herein, against the claim of any person or persons whomsoever,
