WITNESSETH that HIS Southlo. LLC , the undersigned, is the owner of a tract of land in
RICHMOND COUNTY, through which Windsor Sprine Road Improvement. lrnown as Windsor Sprine Road,
Improvement Proiect, has been laid out by W. R. Toole Engineers, Inc., being more particularly described in a
map and drawing of said project in the Public Works and Engineering office, to which reference is hereby made.
NOW, THEREFORE, in consideration of the benefit to said property by the construction and maintenance
of said project, and in consideration of ONE DOLLAR ($1.00), in hand paid, the receipt whereof is hereby
aclrnowledged, I do hereby grant, sell and convey to Augusta, Georgia, a political subdivision of the State of
Georgia, and their successors in office, so much land as to make a right-of-way for said project as surveyed.
SAID right-of-way is hereby conveyed in fee simple, consisting of 0.30 acre, more or less; and NI A acre
of pennanent drainage, utility and maintenance easement, more or less; and 10.260.21 sq. ft. of temporary
construction easement, more or less, as shown on a drawing of the property prepared by W. R. Toole Engineers,
Inc., dated January 8. 2000, and revised March 24. 2000, attached hereto and made a part ofthis description.

TO HAVE AND TO HOLD the said conveyed premises in fee simpie.
I hereby specially warrant that I have the right to sell and convey said land and bind myself, my heirs,
executors and administrators forever to defend by virtue of these presents.

All THAT TRACT OR PARCEL OF LAND lying and being in the 86th
G.M.D., Augusta, Richmond County, Georgia, Tax Map 122-1, Parcel 47.1,
and being more particularly described as follows:
A Right of Way beginning at a point and continuing in an easterly direction
for a distance of 213.69 feet to a 'point; thence South a distance of 25.56 feet
to a point; thence West a distance of 218.99 feet to a point; thence in a
northeasterly direction for a distance of 28.73 feet to the point of beginning,
which property is more particularly shown and described in the plat attached
hereto.

The construction work to be completed on parcels 222, 47.1 and 102 shall be performed in such a
manner that no more than one of the driveways giving access to the Orchard Square Shopping
Center from Windsor Spring Road shall be blocked at anyone time.
The County's contractor shall: (i) perform its work in a neat, first class manner including keeping
the Temporary Construction Easement graded and clear of unused materials and rubbish, (ii) not
locate a construction trailer on the Temporary Construction Easement, (iii) not store construction
equipment on the Temporary Construction Easement long-term (e.g. more than two nights in a
row) -and (iv) I~ave the Temporary Construction Easement smooth graded (to a hand rake
standard) and sodded or seed planted with grass and shall continue to seed same until the grass is
established without bare patches.
Parcel 47.1 is split into an eastern portion and a western portion. The 20.0' x 10.0' area located
55.0' from the western end of the eastern portion of parcel 47.1 as marked on the attached survey
is excluded from the Temporary Construction Easement, and the County's contractor shall use all
care necessary so as not to damage the landowners monument sign installed therein.
The County or its contractor may use the Temporary Construction Easement in a manner
consistent with the construction of the Walgreen's facility and attendant parking areas. Southeast
or its contractor shall be permitted to grade, install asphalt, install curb and gutter, install utility
lines and facilities and install landscaping within the Temporary Construction Easement located
on Parcel 102 and the western portion of Parcel 47.1. Both the County's contractor and the
Walgreen contractor shall coordinate all work in the immediate vicinity of said Temporary
Construction Easement provided such work occurs simultaneously. The materials and
construction methods of both contractors (for any work located in the Temporary Construction
Area that is part of the support system for the widened road) shall conform to those defined in the
GADOT Standard Specifications, Current Edition. If the work at this location does not occur
simultaneously, then the latter of the two contractors shall be responsible for conforming to the
work of the first contractor (for any work located in the Temporary Construction Area).
The landowners have installed the required trees, landscaping and irrigation within the Right-Of-
Way and Temporary Construction Easement area on the western portion of parcel 47.1. In the
event said items are damaged or removed by the County or its contractor, the landowner shall not
be required to repair or replace same nor may the landowner's bonq be drawn to pay for the
repair or replacement of same.
