Road Improvement Proiect, has been laid out by W. R. Toole Engineers, Inc., being more particularly described in a map and draw~ng of said project in the Public Works and Engineering office, to which reference is hereby made. NOW, THEREFORE, in consideration of the benefit to said property by the construction and maintenance of said project, and in consideration of ONE DOLLAR ($1.00), in hand paid, the receipt whereof is hereby acknowledged:. I do hereby grant, sell and convey to Augusta, Georgia, a political subdivision of the State of Georgia, and their successors in office, so much land as to make a right-of-way for said project as surveyed. SAID :;ight-of-way is hereby conveyed in fee simple, consisting of 0.088 acre, more or less; and N/A acre of permanent drainage, utility and maintenance easement, more or less; and 2,249.90 sq. ft. of temporary construction easement, more or less, as shown on a drawing of the property prepared by W. R. Toole Engineers, Inc., dated January 8,2000, and revised March 24, 2000, attached hereto and made a part of this description. See "Special Stipulation Page." TO HAVE AND TO HOLD the said conveyed premises in fee simple. I hereby specially warrant that I have the right to sell and convey said land and bind myself, my heirs, executors and administrators forever to defend by virtue of these presents. Book 00737:2060 Augusta - Richmond County 2001019841 07/05/2001 16:57:42.00 - Special Stipulations Pa~e - The construction work to be completed on parcels 222, 47.1 and 102 shall be performed in such a manner that no more than one of the driveways giving access to the Orchard Square Shopping Center from Windsor Spring Road shall be blocked at anyone time. The County's contractor shall: (i) perform its work in a neat, first class manner including keeping the Temporary Construction Easement graded and clear of unused materials and rubbish, (ii) not locate a construction trailer on thc Temporary Construction Easement, (iii) not store construction equipment on the Temporary Construction Easement long-term (e.g. more than two nights in a row) and (iv) leave the Temporary Construction Easement smooth graded (to a hand rake standard) and sodded or seed planted with grass and shall continue to seed same until the grass is established without bare patches. The landowners have installed the required trees, landscaping and irrigation within the Right-Of- Way and Temporary Construction Easement Area of parcel 222. In the event said items are damaged or removed by the County or its contractor, the landowncr shall not bc required to repair or replace same nor may the landowner's bond be drawn to pay for the repair or replacement of same.
