Richmond County, Georgia, known as BERTRAM VILLAGE and in
the building of a housing subdivision on said land, it has laid
out a storm drainage and road and street system for only
Buckhaven Lane, the.entrance road, shown as PUBLIC ROAD; and,
WHEREAS, it is the desire of W. Sid Beckum;~Ci;.XaYeii_(fe"H;Manly, Jr..,
& 'Glynn Brucker,

system for Buckhaven Lane (Public Road) being the entrance road to
said subdivision running from Bertram Road to Lot 1, Block C,
,of said ~ubdivision, to Richmond County, Georgia, a political
subdivision acting ~y and through its 'Commission/Council for
maintenance and control; and,
WHEREAS, a plat of said property has been prepared by H.
Lawson Graham and Assoc., Inc., dated July~ 1997, revised 8/11/97,
revised 8/15/97, and revised on ~1!18/9~, and recorded in the
Office of the Clerk of the Superior Court of Richmond C~unty,
Georgia, in Reel ..5 g 3, atPage~~'to which referenC::e'is made
to said plat for a more complete and accurate description as to the

. WHEREAS, Richmond County, Georgia, by and through its
Commission\Council, has ~ohsented and agreed to accept and maintain
said storm drainage system and road and street system for Buckhaven
Lane, the Public Road, only, and being the main entrance road.
NOW THEREFORE, this indenture made this ~day of

Party of the First Part, and RICHMOND COUNTY, A POLITICAL
SUBDIVISION, by and through its Commission/Council, hereinafter
referred to as the party of the second part:

The said Party of th~ First Part for and in consideration
of the sum of One Dollar ($1.00) in cash, to it in hand well and
truly paid by the Party of the Second Part, receipt of which is
hereby acknowledged at and before the sealing and delivery of these
presents and further consideration of the benefits to its property
by the maintenance of said storm drainage system and road and
street system for the said Buckhaven Lane, entrance road only, by
the party of the' second part, has and does by these presents,
grant, bargain, sell and confirm unto the said party of the second
part, its successors and assigns, the following, to-wit:
All that right, title and interest and estate of the
Party of the First Part in and to the storm drainage
system and road and street system located on Buckhaven
,Lane, entrance road, only, marked (Public) and running
from Bertram Road to Lot 1, Block C, of Bertram Village
as shown on a plat thereof dated 7/97, having bee I! revised

prepared by H. Lawson Graham, and being a plat of
Bertram Village, and recorded in the Office of ,the Clerk
of the SUEerior Court of Richmond count,y, Georgia, in
Reel 59.5 at page~/rr/--02./.YC; reference is hereby made
to said plat for a more complete and accurate description
as to metes, bounds, and location of said property.
Together with all of the necessary rights of ingress and
egress for the purpose of maintaining the described storm
drainage system,and road and street system for Buckhaven
Lane.
This deed is subject to any utility easements which have been
granted in the past and all telephone lines, gas lines, or
power lines for the transmission of electricity which has been
granted in the past and the Grantor herein reserves an
easement over storm drainage system, water distribution
system, and road and street system, herein conveyed for the
purpose of the maintenance and installation of power lines for
the transmission of electricity, telephone lines, and gas
lines for the purpose of serving said subdivision and the
property adjacent thereto.
This deed is subject to a minimum 15 ft. wide utility easement
to be provided to Augusta/Richmond County centered over all
sanitary sewer lines and water mains as shown and over
entire area shown as private street right-of-way to include a
minimum of 3 ft. off edge of paving for location of meters,
maintenance and extension of sanitary sewer and water system.
TO HAVE AND TO HOLD said storm drainage system and road and
street system for Buckhaven Lane, entrance road only (marked
Public), together with all and singular, the rights, members,
appurtenances thereof to the same being, belonging, or in anywise
appertaining to the only proper use, benefit and behoof of the said
party of the second part, its successors and assigns, forever, IN
FEE SIMPLE.
AND, the said party of the .f irst part, their heirs and
assigns; wirl warrant.and defend the right and title to the above
described property, to the said party of the second part, its
successors and assigns, against all claims of all persons

RESOLUTION ADDING ROAD TO THE
AUGUSTA ROAD SYSTEM
WHEREAS,
Buckhaven Lane
is an existing road in
Richmond County, Georgia, open to public usage; and
WHEREAS, Augusta desires to make Buckhaven Lane a
part of its Road System.
NOW, THEREFORE, BE IT RESOLVED by the Commission-
Council of Augusta, Georgia, that Buckhaven Lane
is hereby
added to its official Augusta Road System of Record, being
described as follows and as shown on the attached sketch map or
plat showing the approximate alignment and location of said road.
(a) Points of beginning and ending:
Beginning at From Bertram Rd.
Extending SE approx. 550 ft. to and
including cul-de-sac
(b) Length of road to nearest 1/100th mile:
0.10 mile
(c) Width & type of road surface:
30 ft. from back of curb to back of
curb; type E asphalt surface
(d) Right-of-Way:
50 ft.

GEORGIII., a political subdivision of the state of Georgia., f1cting
by and through its Commission-Council, hereinafter referred to as

WHEREAS, Developer requested that the Augusta-Richmond
County Commission-Council ~ccept. certain roads, storm drains and

, as shown by deed contemporaneously tendered and recorded in
the office of the Clerk of the Superior Court of Richmond County,
Georgia, in Realty Reel , page and
WHEREAS, Richmond County has adopted a policy req~iring
tho Developer to maintain all installations laid or installed in
the subdivision for a period of twelve months, which the ~ounty
accepts by deed;
NOW, THEREFORE, in consideration of the premise~, the:
expense previously incurred by Developer and the mutual agreements
hereinafter set o~t, IT IS AGREED that:
(1) The County accepts the roads, storm drains and
appurtenances, respectfully described in the deed
contemporaneously tendered herewi'thto Augusta-Richmond County
Commission-Council, recorded in the office of the Clerk of the
Superior ~ Court of Richmond County, Georgia, in Realty Reel
, page
(2) The Developer agrees to maintain all 'the
installations laid or installed in said SUbdivision as desqrihed
in said deed for a period ot twelve months from the date heirein.
; (J) The Developer agrees that. If during said t,wel Ve
month period there is a failure of the installations laid or
installed in said subdivision described in the deed due to failure
of material or poor workmanship, the Developer sha~l he

responsible for adequate maintenance and repair.
(4) In the event of such fallure of the improvements,
the County shall notify the Developer and set forth in writing the
items in need of repair. The Developer shall present within
fifteen business oays its proposed plan of repair and shall have
the repairs completed at a,reasonable time, as determined by the
county.
(5) In the event of an emergency, as determined by the
county, and the Developer is unable to respond in a timely ~anner,
the County shall be au'thorized to erect barricades, traffic
direction devices and such other temporary measures as are
necessary to remedy 'the emergency nature of the problem a1: the
Develope_r! s expense and to allow the Developer time to mak~ the
needed repairs.

(6) In the event the Developer fails to comply with the
terms, of this agreement, then the County shall proceed to have tile
necessary corrective ~ork done, and the Deveioper agrees to be
responsible to the County for payment in full of costs of
repairing the improvements due to failure of material o-t poor
workmanship as liquidated damages,

and seal and the County has caused the execution of this agreement
by and through its duly authorized officers and agents, ~ith its
