WID. ~yra War~lck Warlick, Tritt & Stebbi 1500 1st Union Bank BId Augus~a, GA 30901 722-7543 STATE OF GEORGIA ) ) ) DEED OF DEDICATION COUNTY OF RICHMOND WHEREAS, Nixon Trusts, a Georgia General Partnership comprised of Scott Nixon Trust, Gwinn Huxley Nixon Trust, Margaret Nixon Mobley Trust, and Francis Cobbs Nixon Trust, as its partners, ("Nixon"), having its principal office in Richmond County, Georgia, owns a tract of land in Richmond County, Georgia, bordering on Walton Way Extension and in the building of a road on said tract, it has laid out an easement, rights-of~way and a road and access system; lines, mains, a drainage area and a surface and storm water drainage system ("Improvements"). WHEREAS, it is the desire of Nixon to deed the improvements to Richmond County Board of Commissioners, a political subdivision of the state of Georgia (the "County"), for maintenance and control; and WHEREAS, the County has consented and agreed to accept and maintain said road and easements. NOW, THEREFORE, this Indenture made this the of :r(ll.,^,~~,\, 199 b, between Nixon and the County. , <J4..d '[?,- ay WITNESSETH: That Nixon, for and in consideration of the sum of One and No/100 Dollars ($1.00) to it in hand well and truly paid by the County, at and before the sealing and delivery of these presents, the receipt of which is hereby acknowledged and for the further consideration of the benefits of its property by the maintenance of said street and access system, surface and storm water systems by the County, has and by these presents does grant, bargain, sell and confirm unto the County, its successors and assigns, the following property, to-wit: A 42' wide street extension .of Skinner Mill Road with an 80-foot right-of-way as well as t~e surfa,::e water. and storm \vater eaSe1!1ents and drainage shown on a record plat for Richmond ,County Board of Commissioners, consisting of 1.92 acres, prepared by Cranston, Robertson & Whitehurst, P.C., dated October 23, 1995, a copy of which is recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia, in Plat Book , Pages , incorporated herein by reference and made a part of this description. TO HAVE AND TO 'HOLD said streets, easements, rights-of- ways, accesses, surface and storm water accumulation and distribution systems and together with all and singular the rights, members, appurtenances thereof to the same being, belonging or in anywise appertaining to the only proper use, benefit and behoof of the County, its successors and assigns, forever in fee simple. AND Nixon, its successors and assigns, will warrant and defend the right and title to the above-described property to the County, its successors and assigns, against all claims of all whomsoever. Augusta, GA '30901 722-7543 STATE OF GEORGIA ) ) ) COUNTY OF RICHMOND THIS AGREEMENT entered into this the _ \ b 4-b, day of -So...\"-.\..<A ~~~;\ 199;.0, by and between NIXON TRUSTS, a Georgia General Partnership comprised of Scott Nixon Trust, Gwinn Huxley Nixon Trust, Margaret Nixon Mobley Trust and Francis Cobbs Nixon Trust, as its partners, hereinafter referred to as "Nixon", and RICHMOND COUNTY, GEORGIA, a political subdivision of the State of Georgia, ,acting by and through its BOARD OF COMMISSIONERS, hereinafter referred to as the "County". WHEREAS, Nixon requested that the Richmond County Board of Commissioners accept certain roads, storm drains and appurtenances for Skinner Mill Road Extension, as shown by deed contemporaneously tendered and recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia, in Realty Reel , Page ; and WHEREAS, Richmond County has adopted a policy requiring Nixon to maintain all installations laid or installed in the subdivision for a period of twelve months, which the County accepts by deed. NOW, THEREFORE, in consideration of the premises, the expense previously incurred by Nixon and the mutual agreements hereinafter set out, IT IS AGREED that: 1. The County accepts the roads, storm drains, and appurtenances, respectfully described in the deed contemporaneously tendered herewith to Richmond County Board of Commissioners, recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia, in Realty Reel , Page 2. Nixon agrees to maintain all the installations laid or installed in said subdivision as described in said deed for a period of twelve months from the date herein. 3. Nixon agrees that if during said twelve month period there is a failure of the installations laid or installed in said subdivision described in the deed due to failure of material or poor v!Orkmanship, Nixon shall be respc;.s~ble for adequate' maintenance and repair. 4. In the event of such failure of the improvements, the County shall notify Nixon and set forth in writing the items in need of repair. Nixon shall present within fifteen (15) business days its proposed plan of repair and shall have the repairs completed at a reasonable time, as determined by the County. 5. In the event of an emergency, as determined by the County, and Nixon is unable to respond in a timely manner, the County shall be authorized to erect barricades, traffic direction devices and such other temporary measures as are necessary to remedy the emergency nature of the problem at Nixon's expense and to allow Nixon time to make the needed repairs. 6. In the event Nixon fails to comply with the terms of this Agreement then the County shall proceed to have the necessary corrective work done, and Nixon agrees to be responsible to the County for payment in full of costs of repairing the 2 .. improvements due to failure of material or poor workmanship as liquidated damages. SUBDIVISION: RESOLUTION 1\DDING R01\D TO TilE RICHMOND COUNTY R01\D SYSTEM WHEREAS, Skinner Mill Road Extension is an existlng road in Richmond County, Georgia open to public usage; and WHEREAS, Richmond County desires to make Skinner Mill Road Extensiona part of its County Road System. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Richmond County, Georgia that Skinner Mill Road is hereby added to its, official Extension County Road System of Record, being described as follows and as shown on the attached sketch map or plat showing the approximate ~lignment and location of said road. (a) Points of beglnning and ending: Beginning at Skinner Mill Road And ending at 917't SW to Walton Way Extension (b) Length of road to nearest 1/100th mile: 0.17 mile (c) width and type of road surface: (d) Hight-of-way: 80 foot The Administrator of Richmond County is hereby directed to forward a certified copy of this Resolution to: Georgia Department of Transportation, Road Inventory section District 2, Post Office Box 0, Tennille, Georgia 31089.
