Shepard, County Attorney Shepard, Plunkett, Hamilton, Boudreaux & Tisdale, LLP 701 Greene St., Suite 104 Augusta, Georgia 30901 STATE OF GEORGIA ) COUNTY OF RICHMOND ) QUIT CLAIM DEED THIS INDENTURE, made this ---.iday of September, 2006, between AUGUSTA, GEORGIA, a political subdivision of the State of Georgia, acting by and through the AUGUSTA-RICHMOND COUNTY COMMISSION, as Party of the First Part, and THE SALVATION ARMY, as Party of the Second Part, WITNESSETH: That this conveyance is made pursuant to a Resolution duly adopted on June 6, 2006, by the Augusta-Richmond County Commission abandoning the property hereinafter described and authorizing the conveyance of said property (a copy of said Resolution being attached hereto as Exhibit "B"). That the said Party of the First Part, does release, remise and forever QUIT-CLAIM unto the Party of the Second Part, its successors and assigns, all the right, title, interest, claim, or demand which the Party of the First Part has or may have had in and to the following described property to wit: See Exhibit A, hereto attached and by reference made a part hereof. Book 01107:0502 Augusta - Richmond County 2007010272 02/28/2007 15:27:43.00 Exhibit A A portion of Walker Street, containing 0.05 acres (2,134 sq ft), beg ~~~y intersection with Beech Street and running east along the northern "old property line" of property now or formerly of The Salvation Army, Inc. a distance of 88.87 feet and running east along the southern "old property line" of now or formerly of The Salvation Army, Inc. a distance of 124.51 feet, all as shown on a compiled map prepared by Toole Surveying Company, Inc. for The Salvation Army, Inc. dated March 29, 2006, reference being made to said plat for a more complete and accurate description of the metes, bounds, courses, distances and location of said property. Book 01107:0503 Augusta - Richmond County 2007010272 02/28/2007 15:27:43.00 Exhibit "B" RESOLUTION FINDING A PORTION OF WALKER STREET CONTAINING 0.05 BEGINNING AT THE INTERSECTION OF BEECH STREET COpy AS HAVING CEASED TO BE USED FOR PUBLIC PURPOSES AND FOR ABANDONMENT OF SAME WHEREAS, the Augusta-Richmond County Commission resolved by Resolution dated June 6, 2006, that the following street in Richmond County, Georgia, has ceased to be used by the public to the extent that no substantial public purpose is served by it: A portion of Walker Street containing 0.05 acres beginning at the intersection of Beech Street, as shown on the attached plat; WHEREAS, the adjoining property owners to the property described above have been notified of the June 6, 2006 Resolution; notice of the proposed abandonment has been published in the Augusta Chronicle once a week for a period of two weeks; and a public hearing on the proposed abandonment has been conducted on July 17, 2006, with no objections being raised as to the abandonment of the street described above; WHEREAS, by virtue of the events set forth above, the property identified as a portion of Walker Street containing 0.05 acres beginning at the intersection of Beech Street, as shown on the attached plat; is deemed abandoned and no longer a part of the Richmond County road system; WHEREAS, notice has been given to the owners of abutting land holding title through the owners from whom Augusta, Georgia acquired the property of said owners' right to acquire the land described above; and WHEREAS, the adjoining property owners have communicated their desire to exercise their right to acquire the above described property; NOW, THEREFORE, it is hereby resolved as follows: 1. It is hereby determined that all requirements of Georgia law for the abandonment of a county roadway have been met and that the street referred to in the Augusta-Richmond County Commission's June 6, 2006 Resolution, and described as a portion of Walker Street containing 0.05 acres beginning at the intersection of Beech Street, as shown on the attached plat; is no longer a part of the Richmond County road system. It is further determined that the Mayor of the Augusta, Georgia shall execute a Quit- Claim Deed and such other documentation as may reasonably be required, in forms approved by the County Attorney, conveying all of Augusta's interest in the property, which interest is subject to all easements of record for utilities, to the adjoining property owners. This Resolution shall be recorded in the Minutes of the Augusta-Richmond County Commission, accompanied by the exhibits referred to herein.
