QUIT CLAIM DEED

THIS INDENTURE, made and entered into this ~ day of January, 2003, between
AUGUSTA, GEORGIA, a political subdivision of the State of Georgia, acting by and
through the AUGUSTA- RICHMOND COUN1Y COMMISSION, as party of the first part,
and ROSS GROVE BAYI'IST CHURCH, as party of the second part;
WITNESSETH
That this conveyance is made pursuant to a Resolution dilly adopted on November
19, 2002, by the Augusta-Richmond County Commission abandoning the property
hereinafter described and authorizing the conveyance of said property (a copy of said
Resolution being attached hereto as Exhibit "A").
That the party of the first part, does release, remise and forever quit-claim unto the
party of the second part, his heirs, successors, and assigns, all the right, title, interest, claim
or demand the said party of the first part has or may have had in and to the following
described property, to wit:

ALL that tract or parcel ofland situated, with all improvements
thereon, lying and being in the State of Georgia, County of
Richmond, and being described as the alley, located on Tax
Map 72-2, between Parcels 457 and 458.
THIS DEED is subject to all easements to Richmond County
and Augusta, Georgia, which have heretofore been granted and
all telephone lines, gas lines, or power lines for the
transmission of electricity which have heretofore been installed
within or across said property with a permanent ten foot
easement over any existing utility being specifically reserved,
where an easement over such utility has not previously been
recorded in the Office of the Clerk of Superior Court of
Richmond County, Georgia, said utility line to be centered
within the ten foot permanent easement hereby reserved.
TO HAVE AND TO HOLD the said described premises to the party of the second
part, so that neither the party of the first part, nor its successors or assigns, nor any other
person or persons claiming under them shall at any time, by any means or ways, have
claim, or demand any right or title to the aforesaid described premises, or appurtenances
of in any iight thereof.
IN WITNESS WHEREOF, the party of the first part hereunto sets its hand and seal,

RESOLUTION
FINDING THE ALLEY LOCATED ON TAX MAP 72-2
BETWEEN PARCELS 457 AND 458 AS HAVING CEASED TO
BE USED FOR PUBLIC PURPOSES AND FOR
ABANDONMENT OF SAME
WHEREAS, the Augusta-Richmond County Commission resolved by
Resolution dated August 6,2002, that the following alley in Richmond County, Georgia,
has ceased to be used by the public to the extent that no substantial public purpose is
served by it: all that alley, located on Tax'Map 72-2, between Parcels 457 ~nd 458, as
shown on attached map;
WHEREAS, the adjoining property owners to the property described above
have been notified ofthe August 6, 2002, ReSOlution; notice of the proposed abandonment
has been published in the Augusta Chronicle once a week for a period of two weeks; and
a public hearing on the proposed abandonment has been conducted on October 21,2002,
with no objections being raised as to the abandonment of the alley described above;
WHEREAS, by virtue of the events set forth above, the property identified
as the alley, located on Tax Map 72-2, between Parcels 457 and 458, as shown on
attached map, is deemed abandoned and no longer a part of the Richmond County road
system; ,
WHEREAS, notice has been given to the owners of abutting land holding
title through the owners from whom Augusta, Georgia acquired the property of said
owners' right to acquire the land described above; and
. .
WHEREAS, an adjoining property owner has communicated its desire to
exercise their right to acquire the above described property;
NOW, THEREFORE, it is hereby resolved as follows:
1. It is hereby determined that all requirements of Georgia law for the
abandonment of a county roadway have been met and that the _alley referred to in the
Augusta-Richmond County Co-mmission'sAugust 6, 2002 Resolution, and described as
the alley; located on Tax Map 72-2, between Parcels 457 and 458, as shown on attached

map, is no longer a part of the Richmond County road system.

2. The adjoining property owner, Ross Grove Baptist Church, has properly
exercised its right to acquire the property described above.
3. It is further determined that the Mayor of the Augusta, Georgia shall
execute a Quit-Claim Deed and such other documentation as may reasonably be required,
in forms approved by the County Attorney, conveying all of Augusta's inter~st in the
property, which interest is subjecfto all easements of record for utilities, to the adjoining
property .owner.
This .Resolution shall be recorded in the Minutes of the Augusta-Richmond
County Commission, accompanied by the exhibits referred to herein.
Duly adopted by the Augusta-Richmond County Commission, this . It/flu
