Warr and Warr Family Limited Partnership, LLLP, a Georgia Limited Partnership, - inafter referred to as OWNER, and Augusta, Georgia, a political subdivision under the 5 of Georgia, hereinafter referred to as AUGUSTA; WITNESSETH, that Owner, for and in consideration of the sum of ONE DOLLAR ($1.00) and and truly paid by Augusta at and before the sealing and delivery of these presents, and .r valuable consideration, the receipt whereof is hereby acknowledged, has granted, 3ained, sold, conveyed and confirmed, and by these presents does grant, bargain, sell, vey and confirm unto Augusta, its successors and assigns, an exclusive utility, access and ntenance easement in perpetuity under, across and through the hereinafter described parcel ind. .0- 023 -00 -0 Said easement consists of 218 Square Feet, more or less, of permanent utility, itenance and access easement, as shown on a plat prepared by W R Toole Engineers, Inc., dated ember 23, 2008, revised April 27, 2009, and attached hereto and made a part hereof, to which rence is made for a more accurate and complete description of the metes, bounds and courses, and g for the purpose of laying, relaying, installing, constructing, extending, adding, operating, accessing, siring and maintaining pipelines transporting and carrying utility services for Augusta. Also 1,133 Square Feet, more or less, of temporary construction easement, as shown on the esaid plat. Said easement being for purpose of digging such trenches in said parcel of land as may necessary, to pile thereon the material excavated, and to haul pipe, supplies and equipment iected with the construction and maintenance thereof, over, along and across the said parcel of land. Owner does also grant, bargain, sell and convey unto Augusta, its successors and gns, the right, but not the duty, to clear and to keep clear, all trees, undergrowth and other ,ructions from said permanent easement, along with the free right of ingress and egress to from said permanent easement for this purpose and all other purposes stated herein. Owner, his successors, heirs, assigns and legal representatives, after the completion of Project, shall have the right to use said parcel of land in any manner not inconsistent or fering with the rights herein granted, excluding however, the right to plant thereon any trees ther vegetation that may interfere with the accessing, expanding, adding, laying, relaying, alling, extending, operating, repairing and maintaining of pipelines transporting and carrying y services and the right to erect, construct or maintain thereon any buildings, structures, or �r permanent improvements. TO HAVE AND TO HOLD the aforesaid rights, ways, easements, privileges and irtenances unto Augusta, its successors and assigns, in perpetuity. And Owner, his successors, heirs, assigns and legal representatives shall and will ver warrant and defend unto Augusta, its successors and assigns, the rights, ways, sments privileges and appurtenances conveyed herein, against the claim of any person or ions whomsoever.
