QUITCLAIM DEED
THIS INDENTURE, hereinafter referred to as "Deed", is made this I rth day of
~(\(.. , 2004, by and between the STATE OF GEORGIA, acting by and
through the State Properties Commission, whose address is One Martin Luther King, Jr., Dr.,
S.W., Suite 204, Atlanta, Georgia 30334, party of the first part, hereinafter called "Grantor,"
and AUGUST A, GEORGIA, a political subdivision of the State of Georgia, acting by and
through the Augusta-Richmond County Commission, whose address is 801 Municipal
Building, Augusta, Georgia 30911, party of the second part, hereinafter called "Grantee," (the
words "Grantor" and "Grantee" to include the plural and their respective heirs, successors and
assigns where the context requires or permits).

WHEREAS, Grantor is the owner of approximately 0.49 acres of improved real
property lying and being in the 600th G. M. District, Augusta, Richmond County, Georgia,
(hereinafter the "Property"), more particularly described on Exhibit "A" attached hereto and
incorporated herein; and
WHEREAS, the Property is under the custody and control of the Georgia Bureau of
Investigation, but is no longer being used for its original purposes; and
WHEREAS, Grantee is desirous of acquiring the Property; and,
WHEREAS, by 2003 Resolution Act No. 194 (S.R. 121), approved May 31,2003, the
General Assembly declared that the State of Georgia is the owner of the Property and that in
all matters relating to the conveyance of the Property the State Properties Commission may
act on behalf of the State of Georgia; and,
WHEREAS, the General Assembly, in said Resolution Act, authorized the Property to
be conveyed by appropriate instrument to Grantee for and in consideration of $1.00, and
other such further consideration as determined by the State Properties Commission so long as
the Property is used for public purposes; and,
WHEREAS, the State Properties Commission, at its duly called meeting on September
25,2003, approved the conveyance of the Property as authorized by said Resolution Act; and,
WHEREAS, the Grantee has previously approved the conveyance herein in accordance
with the terms authorized by the Grantor.
NOW, THEREFORE, Grantor, for and in consideration of the mutual public
benefit, and other good and valuable consideration, in hand paid at and before the signing,
sealing and delivery of these presents, the receipt and sufficiency of which is hereby

acknowledged, does hereby remise, convey and forever quitclaim unto Grantee all of

Grantor's right, title and interest in the Property, being more particularly described in Exhibit
A, which is attached hereto, incorporated herein and by this reference made a part hereof.
The Property and any buildings, other structures or improvements, fixtures, and
real and personal property situated on the Property, if any, herein conveyed are hereby
conveyed by Grantor to Grantee upon an "AS IS" and "WHERE IS" basis. Neither Grantor
nor any person or entity of any kind or nature whatsoever acting for or on behalf of Grantor either
has made or hereby makes any representation or warranty whatsoever with respect thereto, whether
express, implied or statutory, including without limitation any representation or warranty as to the
condition of the Property.
TO HAVE AND TO HOLD the Property, with all and singular the rights,
members and appurtenances thereof, to the same being, belonging or in anywise appertaining,
to the only proper use, benefit and behoof of Grantee forever, without warranty of any type,
kind or nature whatsoever, so long as the Property is used for public purposes,
IN WITNESS WHEREOF, Grantor, acting by and through its duly authorized
officials, has caused this Deed to be signed, sealed and delivered in its name, all as of the day,
month and year first above written.

Legal Description
All that tract of land situate, lying and being in the City of Augusta, Richmond County,
Georgia, containing approximately 0.49 acres of improved real property, lying and being in
the 600th G. M. District, Augusta, Richmond County, Georgia, shown on a plat of survey
entitled "Proposed Acquisition by the State of Georgia" by Charles T. Dillard, Georgia
Registered Land Surveyor No. 1834, dated September 1, 1976, a copy of which is attached
hereto, incorporated herein, and by this reference made a part hereof. Said Property being the
same property conveyed by the City Council of Augusta to the State of Georgia by Warranty
Deed recorded in Reel No. 90 Pages 1572-1574 and being more particularly described
therein.
