QUIT CLAIM DEED
THIS INDENTURE, made and entered into this ~day of December, 2003,
between AUGUSTA, GEORGIA, a political subdivision of the State of Georgia, acting by
and through the AUGUSTA-RICHMOND COUN1Y COMMISSION, as party of the first
part, and CASTLEBERRY'S FOOD COMPANY, as party of the second part;
WITNESSETH:
That this conveyance is made pursuant to a Resolution duly adopted on December 2,
2003, by the Augusta- Richmond County Commission abandoning the property hereinafter
described and authorizing the conveyance of said property (a copy of said Resolution being
attached hereto as Exhibit "A").
That the party of the first part, does release, remise and forever quit-claim untQ the
party of the second part, his heirs, successors, and assigns, all the right, title, interest, claim
or demand the said party of the first part has or may have had in and to the following
described property, to wit:

ALL that tract or parcel ofland situated, with all improvements
thereon, lying and being in the State of Georgia, County of
Richmond, and being described as the portion of Garlington
Avenue, at its intersection with Government Street, adjacent to
Castleberry's Food Company. For a more complete and
accurate description as to the metes, bounds and location of
said property, reference is hereby made to the plat recorded in
the office of the Clerk of the Superior Court for Richmond
County, Georgia, at Realty Book , pages
THIS DEED is subject to any utility easements which have
been granted in the past and all telephone lines, gas lines, or
power lines for the transmission of electricity which have been
granted in the past.
TO HAVE AND TO HOLD the said described premises to the party of the second
part, so that neither the party of the first part, nor its successors or assigns, nor any other
person or persons claiming under them shall at any time, by any means or ways, have
claim, or demand any right or title to the aforesaid described premises, or appurtenances of
in any right thereof.
IN WITNESS WHEREOF, the party of the first part hereunto sets its hand and seal,

RESOLUTION
FINDING GARLINGTON AVENUE, AT ITS INTERSECTION
WITH GOVERNMENT STREETf ADJACENT TO
CASTLEBERRY'S FOOD COMPANY, LOCATED ON TAX
MAP 58-2 AS HAVING CEASED TO BE USED FOR PUBLIC
PURPOSES AND FOR AJBANDONMENT OF SAME
WHEREAS. the Augusta-Richmond County Commission resolved by
Resolution dated September 16, 2003, that the following street in Richmond County,
Georgia, has ceased to be, used by the public to the extent that no substantial public
purpose is served by it: the portion of Garlington Avenue, at its intersection with
Govemment Street, adjacent to Castleberry's Food Company, located on Tax Map 58-2, as
shown on the attached map;
WHEREAS. the adjoining property owners to the property described above
have been notified of the September 16, 2003, Resolution; notice of the proposed
abandonment has been published in the Augusta Chron;cle once a week for a period of
two weeks; and a publiC hearing on the proposed abandonment has been conducted on
October 8. 2003. with no objections being raised as to the abandonment of the street
described above;
WHEREAS, by virtue of the events set forth above, the property identified as
tbe:portion of Garlington Avenue. at its intersection with Government Street, adjacent to
Castleberry's Food Company, as shown on attached map. is deemed abandoned and no
longer a part of the Richmond County road system;
WHEREAS, notice has been given to the owners of abutting land holding title

through the owners from whom Augusta, Georgia acquired the property of said owners'
right to acquire the land described above; and
WHEREAS, an adjoining property owner has communicated its desire to
exercise their right to acquire the above described property,
NOW, THEREFORE, it is hereby resolved as follows:
1. It is hereby determined tJhat all requirements of Georgia law for the
abandonment of a county roadway have been met and that the street referred to in the
Augusta-Richmond County Commission's September 16,2003, Resolution, and desaibed
as the portion of Garlington Avenue, at its intersection with Govemment Street, adjacent to
Castleberry's Food Company, as shown on attached plat, is no longer a part of the
Richmond County road system,
2. The adjoining property owner, Castleberry's Food Company, has properly
exercised its right to acquire the property described above for the sum of $1,000.00,
3. It is further determined that the Mayor of Augusta, Georgia shall execute a
Quit-Claim Deed and such other documentation as may reasonably be required, in forms
approved by tt1e County Attorney, conveying all of Augusta's interest in the property, 'v'v'hich
interest is subject to all easements of record for utilities, to the adjoining property owner,
This Resolution shall be recorded in the Minutes of the Augusta-Richmond
County Commission, accompanied by the exhibits referred to herein.
