Georgia 30901 (706) 722-0768 STATE OF GEORGIA COUNTY OF RICHMOND QUIT CLAIM DEED 7& ~ THIS INDENTURE, made and entered into this L- day of , 2001, between AUGUSTA, GEORGIA, a political subdivision of the State of Georgia, acting by and through the AUGUSTA-RICHMOND COUNIY COMMISSION, as successor to The City Council of Augusta, as party of the first part, and BEULAH GROVE BAPTIST CHURCH, INC., as party of the second part; WITNESSETH That this conveyance is made pursuant to a Resolution duly adopted on July 3, 2001, by the Augusta- Richmond County Commission abandoning the property hereinafter described and authorizing the conveyance of said property (a copy of said Resolution being attached hereto as Exhibit "A"). That the party of the first part, does release, remise and forever quit-claim unto the party of the second part, his heirs, successors, and assigns, all the right, title, interest, claim or demand the said party of the first part has or may have had in and to the following Page lof2 T I. . Book 007441257 Augusta - Richmond County 2001025087 08/17/2001 15:39:44.00 described property, to wit: ALL that tract or parcel ofland situated, with all improvements thereon, lying and being in the State of Georgia, County of Richmond, City of Augusta, and being described as that portion of Browns Lane beginning with its intersection with Roulette Lane and ending at its intersection with Poplar Street. THIS DEED is subject to any utility easements which have been granted in the past and all telephone lines, gas lines, or power lines for the transmission of electricity which have been granted in the past. Grantor also herein reserves the road and street system herein conveyed for the purpose of the maintenance and installation of power lines for the transmission of electricity , telephone lines, and gas lines for the purpose of serving said property and the property adjacent hereto. TO HAVE AND TO HOLD the said described premises to the party of the second part, so that neither the party of the first part, nor its successors or assigns, nor any other person or persons claiming under them shall at any time, by any means or ways, have claim, or demand any right or title to the aforesaid described premises, or appurtenances of in any right thereof. '-.. ... -.- ~ .,..~. ; r ::~~ _'. & _ _ _ _<.::--"" / -~ '- --... ~...... .; . <.. ~.r-:-;-Pa:ge '2 of; ................_-~---:<'..-- , " ~, Book 007441258 Augusta - Richmond County 2001025087 08/17/2001 15:39:44.00 RESOLUTION ABANDONING A PORTION OF BROWNS LANEAN-o' AUTHORIZING'" CONVEYANCE r -;- WHEREAS, the Augusta-Richmond County Commission resolved by Resolution dated May 1, 2001, that the following street segment in Richmond County, Georgia, has ceased to be used by the public to the extent that no substantial public purpose is served by it: that portion of Browns Lane, beginning at its intersection with Roulette Lane and ending at its intersection with Poplar Street, as shown on attached plat; WHEREAS, the adjoining property owners to the property'described above have been notified of the May 1, 2001, Resolution; notice of the proposed abandonment has been published in the Augusta Chronicle once a week for a period of two weeks; and a public hearing on the proposed abandonment has been conducted on June 6, 2001, with no objections being raised as to the abandonment of the street segment described above; ; WHEREAS, by virtue of the events set forth above, the property identified as that portion of Browns Lane, beginning at its intersection with Roulette Lane and ending at its intersection with Poplar Street, as shown on attached plat, is deemed abandoned and no longer a part of the Richmond County road system; WHEREAS, notice has been given to the owners of abutting land holding title through the owners from whom Augusta, Georgia acquired the property of said owners' rightto acquire the land described above; and WHEREAS, an adjoining property owner has communicated its desire to exercise its right to acquire the above described property; NOW, THEREFORE, it is hereby resolved as follows: 1. It is hereby determined that all requirements of Georgia law for the abandonment of a county roadway have been met and that the street segment referred to in the Augusta-Richmond County Commission's May 1, 2001 Resolution, and described as that portion of Browns Lane, beginning at its intersection with Roulette Lane and ending 1 Z. )C~'\b i + f/ A \\ " . ,.' The adj?ining property owner, Beulah Grove Baptist'Church, Inc., has properly exercised its right to acquire the property described above. 3. It is further determined that the Mayor of the Augusta, Georgia shall execute a Quit-Claim Deed and such other documentation as may reasonably be required, in forms approved by the County Attorney, conveying all of Augusta's interest in the property, which interest is subject to all easements of record for utilities, to the adjoining property owner.
