OWNER'S AFFIDAVIT
Personally appeared before me, the undersigned officer, David S. Copenhaver, who, being duly swom according to
law, depose(s) and say(s) on oath as follows:
That property known as:
All that tract, lot or parcel of land with improvements thereon situate, lying and being in the
State of Georgia, County of Richmond, City of Augusta, on the Northeast corner of the
intersection of Wrightsboro Road and Baker Avenue being shown and designated as "Tract
A", on a certain plat made for Augusta - Richmond County Commission, by Toole
Surveying Company, Inc, dated January 7, 2008, revised on May 7, 2008 and recorded in the
Office of the Clerk of Superior Court of Richmond County, Georgia in Book 00004, page
156; reference being hereby made to said plat for a more complete and accurate description
as to the metes, courses, bounds and location of said property. The improvements on said
property are known as 1328 Baker Avenue under the present system of house numbering in
Augusta, Georgia.
Tax Map and Parcel Number: 045-3-242-00-0
is owned by AUGUSTA, GEORGIA ("owner") and there is no outstanding indebtedness for equipment, appliances,
or other fixtures attached to said property;
That there are no unpaid or unsatisfied security deeds, mortgages, claims of lien, special assessments for sewage or
street improvements, or taxes which could constitute a lien against said land, except:
NONE, except as shown on the settlement statement and being paid at closing and taxes for
the current year not yet due and payable.
That no person other than the owner, or those persons claiming under and through the owner, claims the right to
possession of said propeliy;
That there is no outstanding indebtedness for sewage, water, garbage or other utilities fumished to said property;
That the lines and comers of said property are clearly marked and there are not disputes conceming the locations of
the lines and comers;
That there are no pending suits, proceedings, judgments, banklUptcies, liens, or executions against said owner either
in the aforesaid County or any other County in the State of Georgia; and
That no labor, materials or services have been filmished to or for the improvement of the subject property by any
third person or entity during the three month period immediately preceding the date of this affidavit; or, if any labor,
materials or services have been so furnished during said three month period, the agreed price or reasonable value of
said labor, materials or services have been paid in full or has been waived in writing by the person or entity so
furnishing or providing same.
This affidavit is given pursuant to 44-14-361.2, O.C.G.A., as part of a transaction involving the sale of the subject
property. Affiant understands that this affidavit is being relied upon by Augusta Properties, L.P. in purchasing the
property from Seller, by Bush Law Firm, P.c. in closing and disbursing upon the transaction and by TIC OR Title
Insurance Company of Florida in issuing title insurance (either Owner's or Mortgagee's) on the premises.
Affiant(s) further say(s) that Seller is not a "foreign person" as defined in Section 1445 of the Internal Revenue
Code; that the his/her/their/its U.S. address is 925 Laney Walker Blvd., Augusta, GA 30901-2959; and that
his/her/their/its tax identification number is 58-2204274. cJl
