HomeMy WebLinkAboutMAGNOLIA AVENUE WARRANTY DEED ,- Return to: County Attorney Office 701 Greene Street, Suite 104 Augusta, Georgia 30901 LIMITED WARRANTY DEED STATE OF GEORGIA ) ) COUNTY OF RICHMOND ) WHEREAS, the City Council of Augusta and Richmond County, Georgia were consolidated into a consolidated city-county government known as Augusta-Richmond County by an act of the Georgia Legislature passed in 1995 with the consolidation of said governments being effective January 1, 1996; and WHEREAS, said consolidated government IS now known as AUGUSTA, GEORGIA and is a political subdivision of the State of Georgia. ,'. NOW THEREFORE, THIS INDENTURE, made this _ day of January, 2007 between AUGUSTA, GEORGIA, acting by and through the Augusta-Richmond County Commission, as party of the First Part, and the AUGUSTA, GEORGIA LAND ,BANK AUTHORITY, as party of the Second Part, WITNESSETH: That this conveyance is made pursuant to a Resolution duly adopted on January sale of property hereinafter described and authorizing the conveyance of said property (a copy of said Resolution being attached hereto as Exhibit "B"). That the said party of the First Part, for and in consideration of the sum of Ten Dollars and other good and valuable consideration, in hand paid, at and before the sealing and delivery of these presents, the receipt of which is hereby acknowledged, has granted, bargained, sold and conveyed, and by these presents does grant, bargain, sell and convey unto the said party of the Second Part, its successors and assigns, the following described property to wit: See Exhibit A, hereto attached and by reference made a part hereof. . TO HAVE AND TO HOLD the said tract or parcel of land, with all and singular the rights, members and appurtenances thereof, to the same being, belonging, or in anywise appertaining, to the only proper use, benefit and behoof of the said party of the Second Part, its successors and assigns, forever, in fee simple. AND THE SAID party of the First Part, for itself, its successors and assigns, will warrant and forever defend the right and title to the above described property, unto the said party of the Second Part, its successors and assigns, against the claims of all persons owning, holding or claiming by, through or under the said party of the First Part. EXHIBIT "A" ALL that lot or parcel of land, with the improvements thereon, situate, lying and being in the 123rd D.G.M. of Richmond County, Georgia, in a certain subdivision known as SunnydalePark. Said lot is all of Lot 18 and the eastern 19 feet of Lot 17, Block 8, on a plat of Sunnydale Park prepared by J.W. Flythe, C.E., dated February, 1926, recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia, in Realty Book 10-R, Page 277. This is the same property conveyed to Thomas B. Fowler and Mrs. Sara E. Flower by deed recorded in Realty Book 16-W, Pages 472-473. Said property is known under the present system of street numbering in Richmond County as 214 Magnolia Avenue and is bounded as follows: North 44 feet by Magnolia Avenue; East 150 feet by Lot 19, Block 8, Sunnydale Park; South 44 feet by Lots 79 and 80, Block 8, Sunnydale Park; and West 150 feet by the remainder of Lot 17, Block 8, Sunnydale Park known in the Augusta-Richmond County Tax Assessors Office as Map Number 48.3, Parcel Number 123.
