Sherrod a/kla Louise L. Jones S rrod, hereinafter referred to as OWNER, and )rgia, a political subdivision under the laws of Georgia, hereinafter referred to as AUGUSTA; ~ESSETH, that Owner, for and in consideration of the sum of ONE DOLLAR ($1.00) in hand and truly sta at and before the sealing and delivery of these presents, and other valuable consideration, the receipt lreby acknowledged, has granted, bargained, sold, conveyed and confirmed, and by these presents does 1, sell, convey and confirm unto Augusta, its successors and assigns, a utility, maintenance and access perpetuity under, across and through the hereinafter described parcel of land. easement consists of 23,506 Square Feet, more or less, as shown on a plat prepared by William R. Gore, lry 2008, attached hereto and made a part hereof, to which reference is made for a more accurate and :;cription of the metes, bounds and courses, and being for the purpose of accessing, laying, adding, anding, installing, extending, operating, repairing and maintaining pipelines transporting and carrying s. ~r does also grant unto Augusta a temporary easement consisting of 37,798 Square Feet, more or less, said plat. Said easement is granted together with the right to dig such trenches in said parcel of land as ssary for the Project, to pile thereon the material excavated, and to haul pipe, supplies and equipment ith the construction and maintenance thereof, over, along and across the said parcel of land. Said sement shall expire at the completion and final acceptance of this pipeline by Augusta. ~r does also grant, bargain, selland convey unto Augusta, its successors and assigns, the right, but not ear, and keep clear, all trees, undergrowth and other obstructions from said permanent easement, along ~ight of ingress and egress to and from said permanent easement for this purpose and all other purposes ~r does agree that no other utilities may be constructed within the aforesaid easement in perpetuity lten permission of the Augusta Utilities Department. lr, his successors, heirs, assigns and legal representatives, after the completion of this Project, shall have Jse said parcel of land in any manner not inconsistent or interfering with the rights herein granted, wever, the right to plant thereon any trees or other vegetation that may interfere with the accessing, I, relaying, installing, expanding, extending, operating, repairing and maintaining of pipelines transporting utility services and the right to erect, construct or maintain thereon any buildings, structures, or other iprovements.
