THIS INDENTURE, made this 16 day of ~, 2007, between
AUGUSTA, GEORGIA, a political subdivision of the State of Georgia, acting by and
through the AUGUSTA-RICHMOND COUNTY COMMISSION, as Party of the First Part,
and JWS INVESTMENT PROPERTIES, LLC, as Party ofthe Second Part,
WITNESSETH:
That this conveyance is made pursuant to a Resolution duly adopted on May 15,
2007, by the Augusta-Richmond County Commission abandoning the property hereinafter
described and authorizing the conveyance of said property (a copy of said Resolution being
attached hereto as Exhibit "B").
That the said Party of the First Part, does release, remise and forever QUIT-CLAIM
unto the Party of the Second Part, its successors and assigns, all the right, title, interest,

claim, or demand which the Party of the First Part has or may have had in and to the
following described property to wit:
See Exhibit A, hereto attached and by reference made a part hereof
TOGETHER WITH all the rights, members and appurtenances to the said described
Property in anywise appertaining or belonging.
TO HAVE AND TO HOLD the said described premises to the said Party of the
Second Part, so that neither the said Party of the First Part nor its successors and assigns,
nor any other person or persons claiming under it shall at any time, by any means or
ways, have, claim or demand any right or title to the aforesaid described Property or its
appurtenances, or any rights thereof.
IN WITNESS WHEREOF, the said Party of the First Part has hereunto set its hand
and seal, the day of year above written.

ALL that lot or parcel of land, with improvements thereon, situate, lying and being in the
City of Augusta, County of Richmond, State of Georgia being shown and designated as a
0.08 acre tract of land beginning approximately 106 feet east of Moore Avenue and
running north approximately 197 feet from Curran Street on a plat dated August 11,2005
prepared by Cranston, Robertson & Whitehurst, P.C. recorded in the Office of the Clerk
of Superior Court of Richmond County, Georgia and recorded in the Office of the Clerk
of the Superior Court of Richmond County, Georgia in..3 , page

and parcel hereof for a more complete and accurate description of the metes, bounds,
courses and distances of said property. The land described is known and referred to as
the Alley off of Curran Street.

RESOLUTION
FINDING THE ALLEY OFF OF CURRAN STREET AS HAVING
CEASED TO BE USED FOR PUBLIC PURPOSES AND FOR
ABANDONMENT OF SAME
WHEREAS, the Augusta-Richmond County Commission resolved by
Resolution dated October 17,2006, that the following alley in Richmond County,
Georgia, has ceased to be used by the public to the extent that no substantial
public purpose is served by it: a 0.08 acre tract of land beginning approximately
106 feet east of Moore Avenue and running north approximately 197 feet from
Curran Street, hereafter referred to as the "Alley off of Curran Street;" and as
shown on the plat attached hereto as Exhibit A;
WHEREAS, there is only one adjoining property owner, identified as JWS
Investments, LLC, and that adjoining property owner has been notified of the
October 17, 2006 Resolution; notice of the proposed abandonment has been
published in the Augusta Chronicle once a week for a period of two weeks; and a
public hearing on the proposed abandonment has been conducted on December
11, 2006, with no objections being raised as to the abandonment of the Alley off
of Curran Street;
WHEREAS, by virtue of the events set forth above, the property identified
as the Alley off of Curran Street, as shown on the attached plat, is deemed
abandoned and no longer a part of the Richmond County road system;

WHEREAS, pursuant to O.C.G.A S 32-7-4, notice has been given to the
abutting land owner of its right to acquire the land described above; and
WHERES, the adjoining property owner has communicated its desire to
exercise its right to acquire the Alley off of Curran Street by payment of the
appraised value of One Thousand Five Hundred Dollars and 00/100 ($1,500.00);
NOW, THEREFORE, it is hereby resolved as follows:
1. It is hereby determined that all requirements of Georgia law for
the abandonrnent of a county roadway have been met and that the street referred
to in the Augusta-Richmond County Commission's October 17, 2006 Resolution,
and described as a 0.08 acre tract ofland beginning approximately 106 feet east
of Moore Avenue and running north approximately 197 feet frorn Curran Street,
and as shown on the map attached as Exhibit "A", is no longer a part of the
Richmond County road system.
2. The adjoining property owner has properly exercised its right to
acquire the property described above for its payment to Augusta, Georgia, of One
Thousand Five Hundred Dollars and 00/100 ($1,500.00).
3. It is further determined that the Mayor of Augusta, Georgia shall
execute a Quit-Claim Deed and such other documentation as may reasonably be
required, in forms approved by the County Attorney, conveying all of Augusta's
interest in the property to the adjoining property owner, which interest is subject
to all easements of record for utilities.

This Resolution shall be recorded in the Minutes of the Augusta-
Richmond County Commission, accompanied by the exhibits referred to herein.
Duly adopted by the Augusta-Richmond County Commission, Georgia this
15th day of May, 2007.

RESOLUTION
FINDING THE ALLEY OFF OF CURRAN STREET AS HAVING
CEASED TO BE USED FOR PUBLIC PURPOSES AND FOR
ABANDONMENT OF SAME
WHEREAS, the Augusta-Richmond County Commission resolved by
Resolution dated October 17, 2006, that the following alley in Richmond County,
Georgia, has ceased to be used by the public to the extent that no substantial

106 feet east of Moore Avenue and running north approximately 197 feet from
