OUlTCLAIM DEED
THIS INDENTURE, made this 5 day of~~1997, between RICHMOND
COUNTY, a political sub~division of the State of Georgia as parties of the first part; (hereinafter
referred to collectively as "Grantor"), and JAMES S, TIMBERLAKE and THOMAS L.
ABERNATHY, both Georgia residents, as tenants-in-common, as party of the second part,
(hereinafter referred to collectively as "Grantee"), (the words "Grantor" and "Grantee" to
include their respective heirs, successors, successors-in-title and assigns where the context
requires permits).
W I T N E S. S. E T H:
Grantor, for and in consideration of TEN AND NO/IOO DOLLARS ($10.00) and other
valuable consideration in hand paid at and before the sealing and delivery of these presents, the
receipt whereof is hereby acknowledged, by these presents does hereby remise, convey and
forever QUITCLAIM unto the said Grantee:
ALL THAT TRACT OR PARCEL OF LAND lying and being in 1269 G.M.D.,
Richmond County, Georgia, which tract is more particularly described on Exhibit "A" attached
hereto and by this reference made a part hereof.
TO HA VE AND TO HOLD the same premises to Grantee, so that neither Grantor nor
any person or persons claiming under Grantor shall at any time, by any means or ways, have,
claim or demand any right or title to said premises or appurtenances, or any rights thereof.
IN WITNESS WHEREOF, the Grantor has signed and sealed this Deed, the day and
year first above written.

LEGAL DESCRIPTION
ALL THAT TRACT OR PARCEL OF LAND lying and being in the 1269th G.M.D.,
Richmond County, Georgia, said tract being more particularly described as follows:
TO FIND THE POINT OF TRUE BEGINNING, commence at a concrete right-of-way
monument found at the intersection of the northerly right-of-way line of Wheeler Road (right-of-
way varies) with the easterly right-of-way line of Bobby Jones Expressway (a.k.a.Interstate
520)(right-of-way varies);
Thence run along the easterly right-of-way line of Bobby Jones Expressway North 140 57' 24"
East a distance of 1117.10 feet to a concrete right-of-way monument found;
Thence continue running along the easterly right-of-way line of Bobby Jones Expressway along
the arc of a curve to the left (said curve having a radius of 2030.60 feet and being subtended
by a chord bearing North 080 05' 53" East and having a chord distance of 479.95 feet) an arc
distance of 481.07 feet to a #4 rebar found;
Thence leaving the easterly right-of-way line of Bobby Jones Expressway South 310 42' 47"
East a distance of 251.35 feet to a nail in a 2" open top pipe found;
Thence South 300 44' 50" East a distance of 180.11 feet to a I" iron pipe found;
Thence run South 180 40' 56" West a distance of 103.21 feet to a point, said point being THE
TRUE POINT OF BEGINNING;
Thence along the arc of a curve to the left (said curve having a radius of 1081.50 feet and being
subtended by a chord bearing South 10 0 17' 03 " West and having a chord distance of 315.92
feet) an arc distance of 317.05 feet to an iron pipe set;
Thence along the arc of a curve to the left (said curve having a radius of 1081.50 feet and being
subtended by a chord bearing South 03044' 28" East and having a chord distance of 212.08
feet) an arc distance of 212.42 feet to an iron pipe set;
Thence South 090 22' 04" East a distance of 94.59 feet to an iron pipe set;
Thence South 360 41' 41" West a distance of 35.16 feet to an iron pipe set on the northerly
right-of-way line of Wheeler Road (right-of-way varies);
Thence run along the northerly right-of-way line of Wheeler Road North 820 42' 09" East a
distance of 93.48 feet to an iron pipe set;

Thence North 090 22' 04" West a distance of 283.23 feet to an iron pipe set;
Thence along the arc of a curve to the left (said curve having a radius of 1047.50 feet and being
subtended by a chord bearing North 040 39' 26" East and having a chord distance of 507.71
feet) an arc distance of 512.82 feet to a point, said point being THE TRUE POINT OF
BEGINNING;
Thence North 180 40' 56" East a distance of 103.21 feet to an iron pin set and THE TRUE
POINT OF BEGINNING.
Said above-described parcel containing 1.04 + acres, and being identified as Tract "4" on that
certain ALTA/ACSM Land Title Survey prepared for James S. Timberlake, Thomas L.
Abernathy, KHY & Associates, L.L.C., First American Title Insurance Company and Buckhead
Title and Abstract Company, prepared by Southern Partners, Inc., bearing the certification and
seal of William F. Todd, Jr., Georgia Registered Land Surveyor Number 2506, dated January
28, 1997, last revised April 28, 1997.
