DEED OF DEDICATION
[Utilities only-Private Streets]
WHEREAS, TCA , LLC, a South Carolina Limited Liability Company, owns
a tract of land (Tax Map 007 Parcel 14.05) in Richmond County, Georgia known as Iron
Horse Aoartments and in the building of a apartment complex on said tract, it has laid
out a gravity sanitary sewerage system, in said complex, part of which includes a
sanitary sewer main; and
WHEREAS, it is the desire of TCA. LLC, to deed the sanitary sewer main
only to AUGUST A, GEORGIA, a political subdivision of the State of Georgia, acting by
and through the Augusta-Richmond County Commission for maintenance and control,
reserving unto itself the maintenance and control of the storm drainage system, the road
and street system, and all ancillary sanitary sewer lines; and
WHEREAS, a site plan of Iron Horse Apartments has been prepared by
Ayercrop, dated February 7 ,1995 and approved by Augusta on May 30, 1995, said
plan being attached to this document and to which reference is hereby made to said plat
for a more complete and accurate description as to the land herein described; and
WHEREAS, AUGUSTA, GEORGIA, by and through the Augusta-
Richmond County Commission, has consented and agreed to accept and maintain said
sanitary sewer main. Augusta, Georgia, and its division known as the Augusta Utilities
Department, will not maintain individual force mains, ancillary sewer lines and/or grinder
pumps, which shall remain private.

AUGUSTA, 'GEORGIA, a political subdivision of the Sate of Georgia, hereinafter
referred to as "Augusta",
WIT N E SSE T H:
That TCA for and in consideration of the sum of Ten and no/100 ($10.00)
Dollars, to it in hand well and truly paid by Augusta at and before the sealing and
delivery of these presents, the receipt of which is hereby acknowledged, and for the
further consideration of the benefits to its property by and through Augusta's
maintenance of said sanitary sewer main, has and does by these presents, grant,
bargain, sell and confirm unto Augusta, its successors, legal representatives and
assigns, the following, to-wit:

A utility, maintenance and access easement, in perpetuity, measuring twenty (20)
feet in width and being shown as "Shaded Area Denotes 20' San. Sewer Easement" on
said Ayercorp site plan, along with the pipelines within said easement.
Together with all of the necessary rights of ingress and egress for the purpose of
maintaining the described sanitary sewer main. This deed is subject to any utility
easements which have been granted in the past and all telephone lines, gas lines, or
power lines for the transmission of electricity which has been granted in the past.
Augusta does agree that it will repair and/or repave any portion, within the twenty
(20) foot easement granted to Augusta herein, through which Augusta may excavate or
perform other work in connection with repairs, construction, maintenance, replacement,
or extension of its sanitary sewer main.
TCA, having elected to maintain the roads and streets as private streets,
covenants that TCA, it successors, legal representative and assigns, shall repair, pave,
or replace any private road or street, or any portion thereof, through which Augusta may
have to excavate or perform work, other than work done on the sanitary sewer main
within Augusta's twenty (20) foot easement granted herein.
TO HAVE AND TO HOLD said easement in perpetuity and sanitary
sewerage system, together with all and singular, the rights, members, appurtenances
thereof to the same being, belonging, or in anywise appertaining to the only p'roper use,
benefit and behoof of Augusta, its successors and assigns forever in fee simple.
AND TCA, it successor, legal representatives and assigns, will warrant
and defend the right and title to the above described property, to Augusta, its
successors and assigns, against all claims of all persons whosoever.
IN WITNESS WHEREOF, the party of TCA has hereunto set its hand and
affixed its seal the day and year first above written.
